MINUTES OF THE COMMON COUNCIL

BRAZIL, INDIANA

FOR DECEMBER 19, 2018

A meeting of the Common Council was held on December 19, 2018 at 5:00 p.m. in the Council Chambers of the Brazil City Hall. The meeting was called to order by Mayor Brian Wyndham.               

ROLL CALL: Steve Bell, Roy Kellar, Angela Modesitt, Brad Deal, Shane Litz and Mayor Brian Wyndham.   

The Pledge to the Flag was led by Mayor Brian Wyndham.

OTHERS PRESENT: City Attorney Traci Orman, Clerk-Treasurer Karen McQueen, Kim McCurrey from the Brazil Times, Leo Southworth, and Russell Lynch.

PRAYER was said by Roy Kellar.

APPROVAL OF MINUTES: October 10, 2018 & October 24, 2018Steve Bell made a motion to approve, seconded by Angie Modesitt.  Passed 5-0.  November 14, 2018 Brad Deal made a motion to approve, seconded by Roy Kellar.  Passed 4-0.  Shane Litz abstained.   

AUDIENCE COMMENTS:

Leo Southworth – Was present to express his concerns with the potential Golf Cart Ordinance.  Leo stated that he would like for the council to refrain from voting on this Ordinance until after they have had a chance to think about what he has presented to them.  

OLD BUSINESS:

  1. Final Action – Britt Tax Abatement:  Resolution 4-2018 and Abatement Calculation Agreement.  Russell Lynch with Britt Aero was present.  Shane Litz made a motion to approve the second reading and final action of a 5year tax abatement contingent on Britt Aero getting there part completed, seconded by Angie Modesitt.  Passed 5-0.
  2. Ordinance 14-2018: Golf Carts (second reading).  The council made a unanimous decision to table this Ordinance to allow further review by our City Attorney Traci Orman. 
  3. Ordinance 15-2018: Golf Carts Signage (second reading).  The council made a unanimous decision to table this Ordinance to allow further review by our City Attorney Traci Orman. 
  4. Amended Ordinance 9-2018 (second reading).  Steve Bell made a motion to approve Ordinance 9-2018, seconded by Shane Litz.  Passed 5-0.   

NEW BUSINESS:

  1. Ordinance 18-2018 (amending Ordinance 10-2018), pertaining to the Waste Water Superintendent’s pay.  Roy Kellar made a motion to suspend the rules and pass Ordinance 18-2018 on the first reading, seconded by Shane Litz.  Passed 5-0.  Shane Litz then made a motion to approve Ordinance 18-2018, seconded by Roy Kellar.  Passed 5-0.
  2. City of Brazil End of Year 2018 Financial Transfers.  Shane Litz made a motion to approve transfer, seconded by Brad Deal.  Passed 5-0.
  3. Project Life – Shane Litz made a motion to commit $3,500.00 to Project Life saver in the 2019 year, seconded by Steve Bell.  Passed 5-0. 

COUNCIL COMMENTS: 

  • Shane Litz – Stated that around a dozen individuals have contacted him regarding the Golf Cart Ordinance.  He commented that he has received very positive feedback.

MAYOR COMMENTS:

  • Mayor Brian Wyndham stated that he was approached recently by the Hendrix Family requesting that Babe Wheeler Park be renamed back to the original name of “Hendrix Park.”  The name change occurred in 1976.  Many ideas have been presented to include a potential basketball court or street name changes to accommodate this request.  The City Attorney Traci Orman commented that she will draft an Ordinance to change the name. 
  • Mayor Brian Wyndham also stated that the Duke Building’s construction is coming along, as lighting is currently being changed. 

ADJOURNMENT: Roy Kellar made a motion to adjourn meeting; seconded by Brad Deal.  The motion passed 5-0.  Meeting adjourned at 5:59 p.m.
