MINUTES OF THE COMMON COUNCIL

BRAZIL, INDIANA

FOR DECEMBER 11, 2019

A meeting of the Common Council was held on December 11, 2019 at 5:00 p.m. in the Council Chambers of the Brazil City Hall. The meeting was called to order by Mayor Brian Wyndham.               

ROLL CALL: Steve Bell, Roy Kellar, Angela Modesitt, Brad Deal and Mayor Brian Wyndham.  Shane Litz was absent.

The Pledge to the Flag was led by Mayor Brian Wyndham.

OTHERS PRESENT: City Attorney Traci Orman, Deputy Clerk Melissa Dorsett, Jason Semler of Baker Tilly, Frank Phillips of the Brazil Times, Karen Boes, Robin Crocker.

PRAYER was said by Roy Kellar.

APPROVAL OF MINUTES: Brad Deal made a motion to approve the October 9, 2019 minutes with a correction that Steve Bell was inquiring about speed limit signs in St. Andrew’s Glen, not requesting; seconded by Roy Kellar.  The motion passed 4-0.  Brad Deal made a motion to approve the November 13, 2019 minutes, seconded by Steve Bell.  The motion passed 4-0.     

AUDIENCE COMMENTS: NONE 

OLD BUSINESS:

  1. Amending Ordinance 12-2019: Mayor’s Salary; Amending Ordinance 13-2019: Clerk-Treasurer’s Salary; Amending Ordinance 14-2019: Common Council’s Salary – Language was added into Ordinance 12-2019, 13-2019 and 14-2019 to address benefits.  Steve Bell made a motion to suspend the rules and pass on 1st Reading; seconded by Angie Modesitt.  The motion passed 4-0.  Steve Bell made a motion to pass Ordinance 12-2019, 13-2019 and 14-2019; seconded by Angie Modesitt.  The motion passed 4-0. 
  2. Ordinance 21-2019: Ordinance Increasing Trash Fee (second reading) – Ordinance 21-2019 will increase trash fees to from $15 to $18 per month effective 1/1/2020 for utility bills due 2/10/2020.  Roy Kellar made a motion to approve Ordinance 21-2019, seconded by Brad Deal.  The motion passed 4-0.
  3. Public Hearing –Additional Appropriation (General Obligation Bonds, second hearing)

A Public Hearing was opened at 5:09 to discuss the General Obligation Bond. Jason Semler from Baker Tilly was present to answer any questions about the Bond.  Roy Kellar would like to see the City bond for equipment and building needs.  The Public Hearing was closed at 5:15.

  • Ordinance 23-2019: Appropriation Ordinance, (General Obligation Bonds, second reading) – Brad Deal made a motion to approve Ordinance 23-2019, and Appropriation Ordinance for General Obligation Bonds; seconded by Steve Bell.  The motion passed 4-0.

NEW BUSINESS:

  1.  Resolution Regarding Establishing Procedure for Grant Applications –  There are several entities and organizations to which the City can apply for grants and the City would like to make sure that there is a central contact for all grant applications..  The Resolution would designate the Planning Administrator as the main contact/liaison for the City.  Angie Modesitt would like to see a firewall in place in case the Planning Administrator serves on a board that would benefit.  City Attorney Traci Orman appreciated that feedback and will make changes and bring the Resolution back for review in January.
  2.  Police Contract 2020- Steve Bell made a motion to approve the Collective Bargaining Agreement between the City of Brazil and Fraternal Order of Police Clay County Lodge #114; seconded by Brad Deal.  The motion passed 4-0.  The agreement is for one year.
  3.  Street Closure Ordinance – The current street closure ordinance is from 2005 and needs to be amended and updated.  Proposed changes will include deleting the Clerk’s signature line and adding the Street Superintendent and changing the time from a calendar year to a shorter period of time.  City Attorney Traci Orman will make changes discussed and bring the Ordinance back for review in January.

COUNCIL COMMENTS: 

Brad Deal – Expressed his appreciation to Roy Kellar for his dedication to the City and is going to miss working together.

Steve Bell – Going to miss Roy and looks forward to working with new Council member Karen Boes

            Angie Modesitt – Will miss Roy and has always appreciated his honesty.

Roy Kellar – Appreciates all that has happened during his time with the City and will miss everyone

MAYOR COMMENTS: Mayor Wyndham expressed his appreciation to Roy Kellar and will be greatly missed.  Mayor welcomed Karen Boes as the new Council member.

ADJOURNMENT: Roy Kellar made a motion to adjourn meeting; seconded by Steve Bell.  The motion passed 4-0.  Meeting adjourned at 5:45 p.m.
