MINUTES OF THE COMMON COUNCIL

BRAZIL, INDIANA

FOR November 8, 2022

A meeting of the Common Council was held on NOVEMBER 8, 2022 at 5:00 p.m. in Brazil City Hall.  The meeting was called to order by Mayor Brian Wyndham.       

ROLL CALL: Mayor Brian Wyndham and Council Members Shane Litz, Karen Boes, Brad Deal, Steve Bell and Angie Modesitt was absent. 

The Pledge to the American Flag was led by Mayor Brian Wyndham.

OTHERS PRESENT:

  • Clerk-Treasurer Karen McQueen, City Attorney Traci Orman, and City of Brazil resident Roy Kellar.

PRAYER: The Prayer was led by Steve Bell

APPROVAL OF MINUTES:   Karen Boes made a motion to approve October 12, 2022, seconded by Steve Bell.  Motion Passed 5-0.

AUDIENCE COMMENTS: None  

OLD BUSINESS: 

  1.  Application for chicken coop – Tyler Webster turned in application that now includes the site map for the chicken coop.  Steve Bell made a motion to approve Tyler Webster’s chicken coop with a variance to omit the fence requirement per city ordinance, seconded by Brad Deal.  Motion passed 3-0.  

NEW BUSINESS:

  1. Floodplain Ordinance: First reading of Ordinance 25-2022 Flood Plain –  Shane Litz made a motion to approve Ordinance 25-2022, seconded by Karen Boes.  Motion passed 4-0.
  2. ARP Plan Amendment Resolution 3-2022 – Brad Deal made a motion to approve Resolution 3-2022, seconded by Steve Bell.  Motion passed 4-0.
  3. ARP Employee Bonus, $3,000.00 for all current Full-time employees and $1,500.00 for all current Part-Time employees, Ordinance 24-2022 – Brad Deal made a motion to suspend the rules and pass Ordinance 24-2022 on the first reading, seconded by Shane Litz.  Motion passed 4-0.  Brad Deal then made a motion to approve Ordinance 24-2022, seconded by Karen Boes.  Motion passed 4-0.    
  4. Recertify Street Cuts & ROW Ordinance 20-2022 – Karen Boes made a motion torecertify Ordinance 20-2022, seconded by Steve Bell.  Motion passed 4-0.
  5. Parking on Church Street – Council would like to see emergency vehicles have a way to drive down street and with current parking being aloud on both sides of street, this is not possible.  City Attorney Traci Orman will put together an Ordinance to limit the parking on a portion of Church Street for the December 2022 meeting.
  6. GAI Paving Inventory – City Attorney and Mayor Brian Wyndham met with GAI and received and updated inventory of all the city streets that have been paved with future projects.  City Attorney Traci Orman explained to council members that she would send out the new inventory map to all of them.     

COUNCIL COMMENTS:  

  • Steve Bell Asked if anyone had any updates on the new powder coating plant.  Mayor Wyndham stated that he had talked with the owner and they are currently working with Duke Energy on the rate that they will be charged at the plant and once this is worked out, they should be opening soon. 
  • Shane Litz – Expressed to other council members his gratitude to the county and city workers for their work on the golf cart paths at the Forest Park Golf Course. 
  • Karen Boes – Wanted Council and the public to be informed that Duke Energy or someone acting on behalf of Duke Energy is calling residents to put a device on A/C Units in order to control energy usage.  Karen stated that she wasn’t clear on how this would work.       

MAYOR COMMENTS:

Mayor Brian Wyndham Asked council for permission to allow him to act on behalf of the City for the bidding and award of the contract to build a new salt building at the new city garage.  Mayor Brian Wyndham estimated that the building would cost roughly $80,000.00 – $90,000.00.  Mayor Brian Wyndham stated that he would keep the council informed.  Council was unanimous in their decision allowing him to act on behalf of the city of Brazil.  Mayor Brian Wyndham also asked the council to approve the payoff of the street department’s Tool Cat/ Bobcat Lease and then the purchase of a new one.  The council unanimously agreed to his request.  The City Water Utility and the City will split the payoff and the purchase.   

FUTURE AGENDA ITEMS: nextCouncil Meeting November 30, 2022 @ 5 pm to discuss Additional Appropriations.

ADJOURNMENT: Steve Bell made a motion to adjourn meeting, seconded by Shane Litz.  Motion passed 4-0. Meeting adjourned @ 6:14 p.m.
