MINUTES OF THE COMMON COUNCIL

BRAZIL, INDIANA

FOR JUNE 8, 2022

A meeting of the Common Council was held on JUNE 8, 2022 at 5:00 p.m. in Brazil City Hall.  The meeting was called to order by Mayor Brian Wyndham.       

ROLL CALL: Mayor Brian Wyndham and Council Members Shane Litz, Karen Boes, Angie Modesitt, Brad Deal and Steve Bell. 

The Pledge to the American Flag was led by Mayor Brian Wyndham.

OTHERS PRESENT:

  • Clerk-Treasurer Karen McQueen, City Attorney Traci Orman. Brazil City Resident Mark Bedwell, Attorney James Deal and Brazil City Fire Department Union President Zach Mormans. 

PRAYER was said by Steve Bell.                      

APPROVAL OF MINUTES: Shane Litz made a motion to approve May 11, 2022 seconded by Steve Bell.  Passed 4-0.

AUDIENCE COMMENTS: NONE

OLD BUSINESS: 

  1. Ordinance #5-2022: Establishing a Demolition Permit System (second reading) – Shane Litz made a motion to approve the second reading of Ordinance #5-2022, seconded by Karen Boes.  Motion approved 5-0.
  2. Ordinance #6-2022: Handicap Parking Spot on Walnut Street – Steve Bell made a motion to suspend the rules and pass Ordinance #6-2022 on the first reading, seconded by Brad Deal.  Motion passed 5-0.  Steve Bell then made a motion to approve Ordinance #6-2022, seconded by Angie Modesitt.  Motion Approved 5-0.

NEW BUSINESS:

  1. Ordinance #7-2022: Petition for Rezoning (1426 E National Ave.) – Current zoning is R1 and request is to make zoning Local Business (LB), the Plan Commissions rezoning decision was favorable.  Shane Litz made a motion to suspend the rules and pass Ordinance #7-2022 on the first reading, seconded by Karen Boes.  Motion passed 5-0.  Shane Litz then made a motion to approve Ordinance #7-2022, seconded by Steve Bell.  Motion was approved 5-0. 
  2. Ordinance #8-2022: Petition for Vacation of Alley (Mark and Gretta Bedwell) –  Attorney James Deal explained Petition and handed out paperwork to Mayor, Clerk and Council members.  Brad Deal made a motion to suspend the rules and pass Ordinance #8-2022 on the first reading, seconded by Shane Litz.  Motion passed 5-0.  Brad Deal then made motion to approve Ordinance #8-2022, seconded by Shane Litz.  Motion was approved 4-1.  Angie Modesitt abstained.
  3.   Review of Britt CF-1s:
  4. Resolution 6-2017 Real Property
  5. Resolution 7-2017 Personal Property
  6. Resolution 4-2018 Personal Property

Steve Bell made a motion for Britt Aero’s CF-1s, Resolution 6-2017, Resolution 7-2017 and Resolution 4-2018 to be in substantial compliance, seconded by Angie Modesitt.  Motion passed 5-0.   

  • Review of Davis Zeller CF – 1s, Resolution 5-2021 and Resolution 16-2015:
  • Resolution 5-2021 Real Property –115 West National Avenue and 202 North Washington Street and Resolution 16-2015 Real Property – 18 west Blaine Street, 305 North Alabama, 420 East Darley, 503 West Kruzan Street, 704 South Depot, and 914 South Walnut.    

Angie Modesitt made a motion for Davis Zeller CF – 1s Resolution 5-2021 and Resolution 16-2015 to be in substantial compliance, seconded by Brad Deal.  Motion passed 5-0. 

  • Review of Owen County Real Estate Holdings, LLC – CF-1s – Resolution 2-2021

Brad Deal made a motion to find Owen County Real Estate Holdings, LLC CF-1s, Resolution 2-2021 to be in substantial compliance, seconded by Steve Bell.  Motion passed 5-0.

  • Resolution 4-2022: Authorizing the Submittal of the CDBG SIP Grant Application to the Indiana Office of Community and Rural Affairs and Addressing Related Matters – Karen Boes made a motion to approve Resolution 4-2022, seconded by Angie Modesitt.  Motion passed 5-0. 
  • Paving of City Parking Lots – Mayor Brian Wyndham also stated that he would like to see council appropriate Covid-19 money to fund the paving of City owned parking lots.  Mayor Brian Wyndham stated that Brazil City was going to request TIFF money to cover some of the expenses for the paving for the parking lots located in the TIFF District.   Council made a unanimous decision to have City Attorney Traci Orman Amend the ARP Plan to fund the paving of the city owned parking lots outside of the TIFF District.

COUNCIL COMMENTS:  

  • Karen Boes – Commented that she would like to see the roads fixed at the intersection of Edgewood Drive and Willow Drive and also see the roads fixed on Pinecrest Drive.  Mayor Brian Wyndham will look into the roads and see the status of fixing the roads.      
  • Brad Deal – Commented that the Gas Company has been doing a great job fixing the roads that they cut for new lines. 
  • Steve Bell – Commented that he would like to see the road fixed at Southgate Boulevard. Mayor Brian Wyndham stated that he will asked the Emmert’s who own the road to fix road.         

MAYOR COMMENTS:

Mayor Brian Wyndham stated that the flags at Forest Park Fountain are suppose to stay at the same height, being equal.  Mayor Brian Wyndham requested council to consider a $1.00 increase in the Stormwater utility that was recently created.  Mayor Brian Wyndham explained that the city would be forced to increase the $5.00 current amount in order to receive extra points when applying for grants.   He also stated that the $1.00 increase would help fund a new position needed due to the MS4 designation.  Council unanimously agreed with Mayor Brian Wyndham and would like to see City Attorney Traci Orman draft an Ordinance to increase the Stormwater fees by $1.00.

ADJOURNMENT: Brad Deal made a motion to adjourn meeting; seconded by Karen Boes. Motionpassed 5-0. Meeting adjourned at 6:11 p.m.
