MINUTES OF THE COMMON COUNCIL

BRAZIL, INDIANA

FOR MAY 11, 2022

A meeting of the Common Council was held on MAY 11, 2022 at 5:00 p.m. in Brazil City Hall.  The meeting was called to order by Mayor Brian Wyndham.       

ROLL CALL: Mayor Brian Wyndham and Council Members Shane Litz, Karen Boes, Angie Modesitt, and Steve Bell.  Brad Deal was absent. 

The Pledge to the American Flag was led by Mayor Brian Wyndham.

OTHERS PRESENT:

  • Clerk-Treasurer Karen McQueen, City Attorney Traci Orman and Frank Phillips with WAMB Radio.

PRAYER was said by Karen Boes.                   

APPROVAL OF MINUTES: Shane Litz made a motion to approve April 13, 2022 and April 27, 2022, seconded by Angie Modesitt.  Passed 4-0.

AUDIENCE COMMENTS: NONE

OLD BUSINESS:  NONE

NEW BUSINESS:

  1. Morris Manufacturing CF-1’s this is to certify that Morris Manufacturing is in compliance. 
  2. 2010-8: REAL
  3. 2013-4: REAL

Shane Litz made a motion that they are insubstantial compliance, seconded by Karen Boes.  Passed 4-0. 

  • Ordinance 3-2022: Demolition Permit – Steve Bell made a motion to approve first reading of Ordinance 3-2022, seconded by Angie Modesitt.  Passed 4-0. 
  • Resolution 3-2022: ARP Plan – US 40 Project to replace the raw water line that runs from the Walnut River to the Water Treatment Plant.  Angie Modesitt made a motion toapprove Resolution #3-2022, seconded by Steve Bell.  Passed 4-0.
  • Ordinance 4-2022: Additional Compensation, Pesticide License – The Forest Park Golf Board would like to see a .50 cent additional compensation for individuals who have a pesticide License.  The board would like this additional compensation to be retroactive to January 1, 2022.  Shane Litz made a motion to suspend the rules and pass Ordinance #4-2022 on the first reading, seconded by Karen Boes.  Passed 4-0.  Shane Litz made a motion to approve Ordinance #4-2022, seconded by Steve Bell.  Passed 4-0. 
  • Wastewater Bond Ordinance #3-2022 – Brad Deal made a motion to suspend the rules and approve Ordinance #3-2022 on the first reading, seconded by Steve Bell.  Motion passed 5-0.  Steve Bell then made a motion to approve Ordinance #3-2022, seconded by Brad Deal.  Motion Passed 5-0.    

COUNCIL COMMENTS:  

  • Karen Boes – Inquired about the Light Pole to be installed in Edgewood Subdivision.  Mayor Brian Wyndham stated that it was on the list with Duke Energy and would be installed hopefully soon.  She then informed council that the sidewalk needed replaced in front of the house at 408 Ringo Drive in Edgewood.  Mayor Brian Wyndham stated that he would get back with her pertaining to the sidewalk. 
  • Shane Litz – Stated that he has heard some negative comments concerning the Brazil Cruise in, he stated that there were lots of burnouts at the intersection of 40 and 59 making things unsafe.  He also stated that roughly 95-98% of the feedback has been positive.  
  • Angie Modesitt – Stated that there is a roll off dumpster obstructing the view for drivers on Franklin Street to the side of the Renaissance building, she wondered if there was any information on this.  Mayor Brian Wyndham stated he would check into this and get back with her.
  • Steve Bell – Stated that the owner of the Edwards Jones Office at the corner of Highway 40 and Walnut Street would like to see a handicap parking space installed for customers on the westside of the road on South Walnut Street.  Council members stated that they would like to investigate this before deciding.  He also stated that the canister lights and the logo sign on the Brazil City Hall building were not lighting up all the way at night and he would like to see them working.  Mayor Brian Wyndham stated that he would investigate this, the lights are on a timer.     

MAYOR COMMENTS:

Mayor Brian Wyndham stated that he would really like to see the council consider black topping the city parking lots.  Mayor Brian Wyndham also stated that there have been some safety issues with the Brazil Cruise in and he would like to see the Cruise in get back to when it first started.  Mayor Brian Wyndham stated that he will be having multiple meetings with the Brazil Police Chief McQueen and the head of the cruise in Mr. Jensen to make sure that things will be safe going forward with the cruise in.  Mayor Wyndham in closure stated that he would like to see the cruise in continue in a safe and family friendly environment.

ADJOURNMENT: Angie Modesitt made a motion to adjourn meeting; seconded by Shane Litz. Motionpassed 4-0. Meeting adjourned at 6:10 p.m.
