MINUTES OF THE COMMON COUNCIL

BRAZIL, INDIANA

FOR MAY 10, 2023

A meeting of the Common Council was held on May 10, 2023, at 5:00 p.m. in Brazil City Hall.  The meeting was called to order by Mayor Brian Wyndham.

The Pledge to the American Flag was led by Mayor Brian Wyndham.

The prayer was led by Karen Boes.      

ROLL CALL: Mayor Brian Wyndham and Council Members, Karen Boes, Steve Bell and Brad Deal, Angie Modesitt (Shane Litz was absent.)

OTHERS PRESENT:

  • City Attorney Traci Orman, Deputy Clerk Melissa Dorsett, Rick Anderson with Veregy, Lori Mayle and Andy Yenchochic with Air Evac, Braden Snider and Raven Snider

APPROVAL OF MINUTES:   Karen Boes made a motion to approvethe April 12, 2023 minutes, seconded by Steve Bell.  Motion Passed 3-0.  Angie Modesitt abstained. 

AUDIENCE COMMENTS:

OLD BUSINESS:

  1. Veregy Report – Rick Anderson with Veregy was present to discuss collaboration with the City to develop energy conservation measures that decrease energy usage and reduce utility costs, including the Wastewater Treatment Plant, City Hall, Street Lights and the Golf Pro Shop.  Summary reports were provided to the Council for review.

NEW BUSINESS:

  1. Air Evac – Lori Mayle and Andy Yenchochic with Air Evac Lifeteam were present to discuss offering the benefit of Air Evac membership to City employees.  Lori and Andy presented multiple options on how the benefit could be offered to the City employees.  Summaries and handouts with cost information were included for the Council to review.
  2. Chicken Coop Application – Raven Snider, 303 E. Railroad St. – Raven and Braden Snider are desiring a chicken coop on their property on 303 E. Railroad St. They completed the application with the attached Residential Domestic Fowl Neighbor Notification and Approval Form and map of desired chicken coop.  Brad Deal made a motion to approve a chicken coop for Raven and Braden Snider on 303 E. Railroad St., seconded by Karen Boes.  The motion passed 4-0.
  3. Ordinance 5-2023: An Ordinance Amending Title XV, Chapter 156, Section 156.031 – Powers of the BZA – Ordinance 5-2023 would revise and add to part (E) of section 156.031 regarding criteria for granting variances in order to conform with state law and to be clear as to the requirements for certain types of variance requests. Brad Deal made a motion to suspend the rules and pass Ordinance 5-2023 on the 1st reading, seconded by Karen Boes.  Motion passed 4-0. Brad Deal made a motion to approve Ordinance 5-2023, seconded by Karen Boes.  The motion passed 4-0. 
  4. Ordinance 6-2023: An Ordinance Amending Title XV, Chapter 156 – Replat Process – Ordinance 6-2023 would set forth a specific process to address the situation of re-plat approval.  Steve Bell made a motion to table the ordinance.  Steve Bell withdrew his motion.  Brad Deal made a motion to suspend the rules and pass Ordinance 6-2023 on the 1st reading, seconded by Karen Boes.  Motion passed 4-0.  Brad Deal made a motion to approve Ordinance 6-2023, seconded by Karen Boes.  Motion passed 4-0.
  5. HEA 1167- City Attorney Traci Orman presented Council with new House Enrolled Act No. 1167 (HEA 1167), effective July 1, 2025 which will require live transmissions of governing body’s meetings, archived copies, and website for live transmissions. 

COUNCIL COMMENTS:  

  • Brad Deal – The City Garage paving looks very nice.  There are still some parking lots that need to be paved, per Ordinance.
  • Angie Modesitt – Asked about illegal burning of trash.  Mayor Wyndham said to call the non-emergency Fire Department number or the Police.

Angie has had multiple complaints about Joink street cuts at Meridian and Halbert.

  • Steve Bell – Has noticed un-mowed property at Jackson St. and Chicago as well as property owned by the railroad.  Janet in Planning and Zoning will be contacted.
  • Karen Boes – Asked about the “Craig Park improvements” previously mentioned.  Mayor Wyndham stated that in general, Craig Park has made improvements and anticipates more with the placement of the bridge and demolition of the Zoo building.

MAYOR COMMENTS:

  • The Baby Box has been installed in the Fire Department but it isn’t live yet.  It is “hot” as the electrical work has been completed but the alarm system still needs to be installed.
  • The fighter jet at the Courthouse now has decals and he would like to see a dedication soon.
  • Parks Superintendent Marv Moon has requested $7900 for sealing the walking track at Forest Park. The Park has already done crack-sealing, but they would like to use the sealing coat on top of the crack-sealing which has been done.  As the Park’s budget is currently rather tight with the ancillary projects to the Splash Pad, Parks is requesting the Council appropriate this $7,900 for this improvement.  Council Members were in agreement and approved the funding of the $7,900 for the Parks to seal the walking track. Council members also agreed that the money could be paid from the ARP funds since this project qualified.

ADJOURNMENT: Steve Bell made a motion to adjourn meeting, seconded by Brad Deal.  Motionpassed 4-0. Meeting adjourned @ 6:30 p.m.
