MINUTES OF THE COMMON COUNCIL

BRAZIL, INDIANA

FOR APRIL 28, 2021

A meeting of the Common Council was held on APRIL 28, 2021 at 5:00 p.m. in the new Police Department training facility. The meeting was called to order by Mayor Brian Wyndham.     

ROLL CALL: Steve Bell, Angela Modesitt, Shane Litz, Brad Deal, Karen Boes and Mayor Brian Wyndham.   

The Pledge to the American Flag was led by Mayor Brian Wyndham.

OTHERS PRESENT:

  • Clerk-Treasurer Karen McQueen, City Attorney Traci Orman, Mike McCracken, Stony Fisher, Graig Bass and Frank Phillips.

PRAYER was said by Steve Bell.                      

APPROVAL OF MINUTES: Shane Litz made a motion to approve the March 10, 2021 minutes, seconded by Karen Boes.  Passed 5-0.

AUDIENCE COMMENTS:

None   

OLD BUSINESS:

  1. Ordinance 11-2021: Stop Sign at Rairdan and JacksonKaren Boes made a motion to suspend the rules and pass Ordinance #11-2021 on the first reading, seconded by Brad Deal.  Karen Boes then made a motion to approve Ordinance #11-2021, seconded by Brad Deal.  Passed 5-0.
  2. Stormwater Ordinance #4-2021 correction (scriveners’ error)Steve Bell made a motion to correct error on page 3, seconded by Angie Modesitt.  Passed 5-0.

NEW BUSINESS:

  1. Chicken Co-op Request – 321 west Hendrix Street, Steve Litz  made a motion to approve the Chicken Coop at 321 West Hendrix Street, seconded by Steve Bell.  Passed 5-0.
  2. Discussion for Street Signs – 824 North Washington Street is requesting a sign be placed warning people of “Blind Person.”  Sign was requested to be placed in the alley behind residence.  Steve Bell made a motion to approve sign placement, seconded by Shane Litz.  Passed 5-0. 
  3. Ordinance 9-2021 Establishing the BPD Forfeiture Asset Fund –Shane Litz made a motion to suspend the rules and pass Ordinance #9-2021 on the first reading, seconded by Brad Deal.  Passed 5-0.  Shane Litz made a motion to approve ordinance #9-2021, seconded by Brad Deal.  Passed 5-0.  
  4. Ordinance 10-2021: Stop sign at Leavitt and Whiterock Road – No action taken.
  5. Ordinance 12-2021: Rezoning 3731 West State Road 340 – Brad Deal made a motion to suspend the rules and pass Ordinance #12-2021 on the first reading, seconded by Angie Modesitt.  Passed 5-0.  Brad Deal then made a motion to approve Ordinance #12-2021, seconded by Angie Modesitt.  Passed 5-0.
  6. Ordinance 13-2021: Rezoning 227 South Lambert – Brad Deal made a motion to suspend the rules and pass Ordinance #13-2021 on the first reading, seconded by Angie Modesitt.  Passed 5-0.  Brad Deal then made a motion to approve Ordinance #13-2021, seconded Angie Modesitt.  Passed 5-0.
  7. Ordinance 14-2021: rezoning 1244 and 1300 East Hendrix Street – Brad Deal made a motion to suspend the rules and pass Ordinance #14-2021 on the first reading, seconded by Angie ModesittBrad Deal then made a motion to approve Ordinance #14-2021, seconded by Angie Modesitt.  Passed 5-0.
  8. Resolution #2-2021: Owen County Real Estate Holdings Request for Real Property Tax Abatement – Brad Deal made a motion to approve Resolution #2-2021 for 10 years on the first reading, seconded by Shane Litz.  Passed 5-0. 
  9. Resolution #3-2021: Indiana Powder Coating Request for Personal Property Tax Abatement – Brad Deal made a motion to approve Resolution #3-2021 for 10 years on the first reading, seconded by Shane Litz.  Passed 5-0.
  10. Ordinance #9-2017: Exception to Truck Routes Ordinance – Brad Deal made a motion for a temporary exemption to Indiana Power Coating’s request for access, until a designated truck route is established, seconded by Steve Bell.  Passed 5-0.

COUNCIL COMMENTS:  

Shane Litz – Stated that he did a follow-up with Commissioner Paul Sinders concerning the parking lot at the community correction’s building.  Commissioner Paul Sinders stated that it was not in their budget to pave the parking lot.

Shane Litz – He recommended paying Kristy Jerrell out of the General Fund for the Covid -19 Food Grant for her services charged to the city. 

Steve Bell – Commented that the neighbors to 517 North Indiana were upset about the trash at 517 North Indiana and would like to see the home cleaned up.   

Mayor Brian Wyndham will look into this.

Next City Council Meeting scheduled for May 26, 2021 at 5:00 p.m. 

ADJOURNMENT: Brad Deal made a motion to adjourn meeting; seconded by Karen Boes.  The motion passed 5-0.  Meeting adjourned at 6:22 p.m.
