THE BOARD OF PUBLIC WORKS AND SAFETY

BRAZIL, INDIANA

FOR DECEMBER 9, 2020

A meeting with the Board of Public Works was held on December 9, 2020 at 10:00 a.m. in the Council Chambers of the Brazil City Hall.  The meeting was called to order by Mayor Brian Wyndham.

Pledge was led by Mayor Wyndham

ROLL CALL: Mayor Wyndham, Ruthann Jeffries, Linda Messmer, Deputy Clerk Melissa Dorsett, City Attorney Traci Orman.

OTHERS PRESENT: Fire Chief Jake Bennett, Police Chief Clint McQueen, PZ Administrator Janet McClellan, PZ Asst Cathy Hunter, Wastewater Supt. Dallas King, John Burk

APPROVAL OF MINUTES:  Linda Messmer made a motion to approve minutes from November 25, 2020; seconded by Ruthann Jeffries.  The motion passed 3-0

NEW BUSINESS: 

  1. John Burk-Car Wash sewer adjustment – John Burk was present to discuss his yearly wastewater adjustment for the car wash.  Ruthann Jeffries made a motion to adjust the wastewater down to 2500 cubic feet of usage for January, February, March bills due to be paid in February, March, April 2021, seconded by Linda Messmer. The motion passed 3-0.
  2. Façade Grant: Agreement and Release regarding Compromise on Jared Grable issues – Some issues have arisen with the Façade Project concerning the Renaissance building, owned by Jared Grable.  All parties have come to an agreement and change orders have been issued to complete the work on the Renaissance building.  Ruthann Jeffries made a motion to approve the Agreement and Release regarding the compromise on the Renaissance building, seconded by Linda Messmer.  The motion passed 3-0.
  3. Façade Grant: Substantial Completion Certificate – Linda Messmer made a motion to approve the Certificate of Substantial Completion dated November 11, 2020, Change Order 002 (administrative document on changed items) and Change Order 003 (painting and trim changes, $5000 to be paid by the City), seconded by Ruthann Jeffries. The motion passed 3-0.
  4. Police Contract – The contract has been negotiated and an agreement has been reached. Linda Messmer made a motion to approve the 3-year Collective Bargaining Agreement between the City of Brazil, Indiana and Fraternal Order of Police, Clay County Lodge #114 for years 2021-2023, seconded by Ruthann Jeffries. The motion passed 3-0.
  5. WW Contract with Staunton for 2021- Ruthann Jeffries made a motion to approve the Agreement for Services between the City of Brazil, Indiana and Town of Staunton, Indiana to provide a certified operator and all necessary services in operating and running the sewage treatment plant for Staunton, effective January 1, 2021 through December 31, 2021, seconded by Linda Messmer.  The motion passed 3-0.  Staunton agrees to pay the City of Brazil $2000 per month as compensation for services.
  6. WW Contract with Center Point for 2021 and Conflict of Interest Waiver – Linda Messmer made a motion to approve the Agreement for Services between the City of Brazil, Indiana and Town of Center Point, Indiana to provide a certified operator and all necessary services in operating and running the sewage treatment plant for Center Point, effective January 1, 2021 through December 31, 2021, and the Waiver of Conflict of Interest, seconded by Ruthann Jeffries.  The motion passed 3-0. Center Point agrees to pay the City of Brazil $1000 per month as compensation for services.
  7. Professional Services Contract for Management of Outside Wastewater Contracts – The City provides a Certified Operator for its Wastewater Treatment Plant and uses the services of this operator, Dallas G. King, Jr to operate both Brazil’s and contracting municipalities Wastewater Treatment Plants.  The City will compensate Dallas with 25% of the 2021 Center Point contract ($12,000) and 25% of the 2021 Staunton contract ($24,000) for a biweekly amount of $314.16. Linda Messmer made a motion to approve the Professional Services Contract for Management Outside Wastewater Contracts, seconded by Ruthann Jeffries.   The motion passed 3-0.
  8. Clean Up -714 N. Meridian – Ruthann Jeffries made a motion to approve property for Clean Up at 714 N. Meridian, seconded by Linda Messmer.  The motion passed 3-0.
  9. Right of Ways – Joink (3), John and John (1) – Linda Messmer made a motion to approve 3 Right of Way Permits for Joink at Terre Haute Savings Bank and 1 Right of Way Permit for John and John at 112 N. Murphy Ave., seconded by Ruthann Jeffries.  The motion passed 3-0.

CLAIMS:

  1. Clerk’s Office – Linda Messmer made a motion to approve the claims from the Clerk’s Office; seconded by Ruthann Jeffries.  The motion passed 3-0.
  2. Utilities’ Office – Ruthann Jeffries made a motion to approve the claims from the Utilities’ Office; seconded by Linda Messmer.  The motion passed 3-0.

FUTURE AGENDA: December 23rd will be the last scheduled meeting for the Board of Public Works and Safety.

ADJOURNMENT: A motion to adjourn the meeting was made by Ruthann Jeffries seconded by Linda Messmer.  The motion passed 3-0.  Meeting was adjourned at 10:30 a.m.
