THE BOARD OF PUBLIC WORKS AND SAFETY

BRAZIL, INDIANA

FOR DECEMBER 23, 2020

A meeting with the Board of Public Works was held on December 23, 2020 at 10:00 a.m. in the Council Chambers of the Brazil City Hall.  The meeting was called to order by Mayor Brian Wyndham.

Pledge was led by Mayor Wyndham

ROLL CALL: Mayor Wyndham, Ruthann Jeffries, Linda Messmer, Deputy Clerk Melissa Dorsett, City Attorney Traci Orman.

OTHERS PRESENT: Fire Chief Jake Bennett, Police Chief Clint McQueen, PZ Asst Cathy Hunter, Brian Baumgartner, Mark Adamson, TJ Sneddon

APPROVAL OF MINUTES:  Linda Messmer made a motion to approve minutes from December 9, 2020; seconded by Ruthann Jeffries.  The motion passed 3-0

NEW BUSINESS: 

  1. Fire Protection Contract for Brazil Township– TJ Sneddon, Brazil Township Trustee, was present to discuss the Fire Protection Contract for 2021. Ruthann Jeffries made a motion to approve the Fire Protection Contract for 2021 between the City of Brazil and Brazil Township, seconded by Linda Messmer.  The motion passed 3-0.
  2. Brian Baumgartner-2021 Wastewater Adjustment – Brian Baumgartner was present to discuss his yearly wastewater adjustment.  Linda Messmer made a motion to approve a 10% monthly wastewater adjustment for 2021, seconded by Ruthann Jeffries.  The motion passed 3-0.
  3. Mark Adamson-2021 Wastewater Adjustment – Mark Adamson was present to discuss his yearly wastewater adjustment.  Linda Messmer made a motion to approve a 10% monthly wastewater adjustment for 2021, seconded by Ruthann Jeffries.  The motion passed 3-0.
  4. Utility Easement with Dan Rose for moving wastewater line – The City has a wastewater line that runs through the middle of a property owned by Dan Rose.  The City would like to move the lines to the edge of the lot which will require an easement from Mr. Rose to the City.  Ruthann Jeffries made a motion to approve the grant of utility easement between Dan Rose and the City of Brazil, seconded by Linda Messmer.  The motion passed 3-0.
  5. Natalie Pierce-Water Issue – (no discussion due to absence of Natalie Pierce)
  6. Right of Way Permit-CSU, Inc-N. Murphy Ave. – Linda Messmer made a motion to approve a Right of Way Permit for Duke Energy at N. Murphy Ave, seconded by Ruthann Jeffries.  The motion passed 3-0.
  7. Permit to Cut City Street-Joink – Ruthann Jeffries made a motion to approve a Permit to Cut into a City Street or Alley for Joink at N. Murphy Ave., contingent on INDOT approval if necessary, seconded by Linda Messmer.  The motion passed 3-0.
  8. Right of Way Permit-Joink – Linda Messmer made a motion to approve a Right of Way Permit for Joink at 1506 E. National Ave, contingent on INDOT approval if necessary, seconded by Ruthann Jeffries.  The motion passed 3-0.

OTHER BUSINESS:

  1. The Board of Works previously approved Collective Bargaining Agreement on December 9, 2020, but the Council made some additional changes to the agreement which included carving out the negotiation of health insurance for each year of the contract. City Attorney Traci Orman asked that the Board re-approve the Collective Bargaining Agreement with the Police Union and the City of Brazil.  Ruthann Jeffries made a motion to approve the Collective Bargaining Agreement with changes, seconded by Linda Messmer.  The motion passed 3-0.

CLAIMS:

  1. Clerk’s Office – Linda Messmer made a motion to approve the claims from the Clerk’s Office; seconded by Ruthann Jeffries.  The motion passed 3-0.
  2. Utilities’ Office – Ruthann Jeffries made a motion to approve the claims from the Utilities’ Office; seconded by Linda Messmer.  The motion passed 3-0.

FUTURE AGENDA: None

ADJOURNMENT: A motion to adjourn the meeting was made by Linda Messmer seconded by Ruthann Jeffries.  The motion passed 3-0.  Meeting was adjourned at 10:20 a.m.
