MINUTES OF THE COMMON COUNCIL

BRAZIL, INDIANA

FOR SEPTEMBER 18, 2019

 

A meeting of the Common Council was held on September 18, 2019 at 5:00 p.m. in the Council Chambers of the Brazil City Hall. The meeting was called to order by Mayor Brian Wyndham.

ROLL CALL: Steve Bell, Roy Kellar, Shane Litz, Angie Modesitt, Brad Deal and Mayor Brian Wyndham.

The Pledge to the Flag was led by Mayor Brian Wyndham.

Prayer was led by Roy Kellar

OTHERS PRESENT: City Attorney Traci Orman, Clerk-Treasurer Karen McQueen, and Ivy Jacobs with the Brazil Times.

APPROVAL OF MINUTES:  NONE    

 

AUDIENCE COMMENTS: NONE

 

OLD BUSINESS: NONE 

 

NEW BUSINESS:

  • Rick Anderson – John Melloh – Energy Savings Provider, was present to discuss options for the city to save money on their utility bills. The Energy Savings Provider is best known in our area for, the solar panels located at the Indianapolis Airport.  Rick Anderson explained that his company would like to do an assessment/study to see how much the city could be saving on energy costs, at no cost to the City of Brazil for the assessment/study.  The company would then report back to the city with its findings.  Shane Litz made a motion to approve the assessment/study, seconded by Brad Deal.  Passed 5-0.
  • Diana Hody was present to request 3 handicap parking spots located at 21 East Church Street – Currently there is 1 spot and she would like 2 more spots for handicap parking. The spots would be located on the Southside of the road, between Walnut and Washington going East on the one-way.  Shane Litz would like to table decision until all council members have had a chance to look at the location.  Mayor Brian Wyndham stated that he would contact the owners of the apartments, the Emmert Realty.  Council will revisit this issue at its October 9, 2019 meeting.
  • Library Board Selection – The City has one (1) appointment to the Brazil City Library Board of Trustees. The City’s previous appointment’s, Georgia Day, term expired on 7-31-2019 and a new appointment is necessary.  The term will run from 7-31-2019 through 7-31-2023.  Jill Scarbrough, Library Director, sent the council a letter and indicated that Dr Richard Frankville would be willing to serve the appointment on behalf of the City.  Traci Orman also expressed interest in the appointment to the board.  Brad Deal made a motion to appoint Traci Orman to the Library Board, seconded by Shane Litz.  Passed 5-0.
  • Public Hearing for the 2020 City of Brazil Budget – Public Hearing was opened up at 5:27 p.m. for the 2020 Budget.  Council decided to set a work session concerning the City of Brazil’s 2020 Budget for September 25, 2019 at 5:00 p.m.  The City of Brazil 2020 Budget Hearing was closed at 5:35 p.m.
  • Ordinance 11-2019 first reading of the 2020 BudgetSteve Bell made a motion to approve the first reading of Ordinance 11-2019, seconded by Angie Modesitt.

Passed 5-0.

  • Ordinance 12-2019 first reading Salary Ordinance regarding Mayor – Shane Litz made a motion to approve the first reading of Ordinance 12-2019, seconded by Brad Deal. Passed 5-0.
  • Ordinance 13-2019 first reading Salary Ordinance regarding Clerk-TreasurerShane Litz made a motion to approve the first reading of Ordinance 13-2019, seconded by Brad Deal. Passed 5-0.
  • Ordinance 14-2019 first reading Salary Ordinance regarding CouncilShane Litz made a motion to approve the first reading of Ordinance 14-2019, seconded by Brad Deal. Passed 5-0.
  • Ordinance 15-2019 first reading Salary Ordinance regarding PoliceShane Litz made a motion to approve the first reading of Ordinance 15-2019, seconded by Brad Deal. Passed 5-0.     

10.)Ordinance 16-2019 first reading Salary Ordinance regarding FireShane Litz

made a motion to approve the first reading of Ordinance 16-2019, seconded by Brad Deal.  Passed 5-0.

11.)Ordinance 17-2019 first reading Salary Ordinance regarding Employees and     

            Appointees- Shane Litz made a motion to approve the first reading of Ordinance 17-

2019, seconded by Brad Deal.  Passed 5-0.

12.)Resolution 4-2019 Dispatch Contract – This is a dispatch contract for 1 year in 2020 in

the amount of $125,000.00.  Shane Litz made a motion to approve Resolution 4-2019,

seconded by Brad Deal.  Passed 5-0.

13.)Ordinance 18-2019 Ordinance approving the execution of a second supplemental     

             lease amending Exhibit B to the lease between Brazil RDA and Clay County      

             Redevelopment Commission –  This Ordinance will allow for the paving of Colfax

Street (beginning at Logan St. and continuing north to Normandy Dr.).  Angie Modesitt

made a motion to suspend the rules and pass Ordinance 18-2019

on the first reading, seconded by Brad Deal.  Passed 5-0.  Angie Modesitt then made a

motion to approve Ordinance 18-2019, seconded by Brad Deal.  Passed 5-0.

14.)Discussion/decision on stop sign at North Ashley and Boone Dunbar – Council

would like City Attorney Traci Orman to prepare an Ordinance for stop signs going

East and West on Boone Dunbar, to be located at Mary Patton Drive and at

Ashley St.       

 

MAYOR’S COMMENTS:

Mayor Brian Wyndham reminded council and the public that the Highway 40 Street Festival was scheduled for Saturday, September 21, 2019.  Mayor Brian Wyndham also stated that the Mayor’s Ride raised over $20,000.00 this year for the Humane Society.

 

COUNCIL COMMENTS:

Angie Modesitt – Stated that Tyler Hutchison had contacted on behalf of the Clay County Community Theatre explaining the they have been receiving a trash bill and have not been using the service.  He requested that the trash bill be removed from their bill.  Mayor Brian Wyndham stated that he would have the bill removed.

 

Brad Deal – Stated that he would like to recognize and say thank you to Tyler Hutchison for his continued involvement within the community and cleaning up Brazil City Streets.

 

Steve Bell – Stated that he wanted to know what we are doing about all of the lighting issues we are having with the decorative lights along US Highway 40?  Mayor Brian Wyndham stated that the City is in the process of documenting all the issues and communications that we have had with the company who made the decorative lights.

 

FUTURE ITEMS:

Next meeting is scheduled for October 9, 2019 at 5 p.m.  A work session to discuss the 2020 City Budget is scheduled for September 25, 2019 at 5:00 p.m.

 

ADJOURNMENT: Shane Litz made a motion to adjourn meeting; seconded by Roy Kellar.  The motion passed 5-0.  Meeting adjourned at 6:16 p.m.
