MINUTES OF THE COMMON COUNCIL

BRAZIL, INDIANA

FOR FEBRUARY 24, 2021

A meeting of the Common Council was held on February 24, 2021 at 5:00 p.m. in the Council Chambers of the Brazil City Hall. The meeting was called to order by Mayor Brian Wyndham.     

ROLL CALL: Steve Bell, Angela Modesitt, Shane Litz, Brad Deal, Karen Boes and Mayor Brian Wyndham.   

The Pledge to the American Flag was led by Mayor Brian Wyndham.

OTHERS PRESENT:

  • Clerk-Treasurer Karen McQueen, Traci Orman City Attorney, Clay County Attorney Eric Somheil, Clay County Councilman Paul Sinders, Clay County Councilman Marty Heffner, Wastewater Superintendent Dallas King, Tony Elkers from Strand, and present via cellphone Doug B with Baker Tilley.

PRAYER was said by Karen Boes.                   

APPROVAL OF MINUTES: Steve Bell made a motion to approve the January 13, 2021 seconded by Shane Litz.  Passed 5-0.

AUDIENCE COMMENTS:

    Clerk-Treasurer Karen McQueen would like the Golf Course Board to take over renewal of the Liquor License annually due to liability concerns.  

OLD BUSINESS:

  1. Amending City Zoning Map: Ordinance 20-2020 (2nd reading) – Steve Bell made a motion to approve second reading of Ordinance 20-2020, seconded by Karen Boes.  Motion approved 5-0.  
  2. Rezoning 919 West Whiterock Road: Ordinance 2-2021 (2nd reading) – Brad Deal made a motion to approve second reading of Ordinance 2-2021, seconded by Angie Modesitt.  Motion approved 5-0.
  3. Hauled Wastewater: Ordinance 3-2021 (2nd reading) – Brad Deal made a motion to approve the second reading of Ordinance 3-2021 with a recommendation for Board of Works to set the fee at $250.00, seconded by Shane Litz.  Motion approved 5-0.
  4. Stormwater: Public Hearing and Ordinance 4-2021 (2nd reading) – Public Hearing was opened up at 5:11 p.m., Tony Elkers with Strand was present for any questions that anyone might have.  With no comments the Public Hearing was then closed at 5:16 p.m.  Brad Deal then made a motion to approve the second reading of Ordinance 4-2021, seconded by Steve Bell.  Motion was approved 5-0.
  5. Handicap Parking Spot at 904 North Meridian Street: Ordinance 5-2021 – Shane Litz made a motion to suspend the rules and pass Ordinance 5-2021 on the first reading, seconded by Karen BoesShane Litz then made a motion to approve Ordinance 5-2021, seconded by Angie Modesitt.  Motion approved 5-0. 

NEW BUSINESS:

  1. OCRA Covid Phase III Grant: Resolution 1-2021; Resolution Authorizing Application Submission and Local Match Commitment – Angie Modesitt made a motion to approve Resolution 1-2021, seconded by Brad Deal.                          Motion approved 5-0. 
  2. Petition for Vacation of Platted but Undeveloped Street and Alley in Stewart’s Third Addition to the City of Brazil: Ordinance 7-2021 and Public Hearing – Brad Deal made a motion to suspend the rules and pass Ordinance 7-2021 on the first reading, seconded by Karen Boes.  Brad Deal made a motion to approve Ordinance 7-2021, seconded by Angie Modesitt.  Motion was approved 5-0.        

COUNCIL COMMENTS:  

Shane Litz

  • Wanted to thank the City Street Department for plowing the roads, he commented that they did a great job.  Shane also stated that the Golf Course is needing to fix the irrigation system and the cost is around $20,000.00.    

Karen Boes–

  • She stated that she wou;ld like the wastewater department to look at a location in Edgewood subdivision, around 408 Ringo Drive, possible sink hole.  Mayor Brian Wyndham stated that he will have them look at it.            

MAYOR COMMENTS: Mayor Brian Wyndham stated that he believes that 2021 will be a better year than 2020 was. 

FUTURE AGENDA ITEMS:

Next City Council Meeting scheduled for March 10, 2021 at 5:00 p.m. 

ADJOURNMENT: Brad Deal made a motion to adjourn meeting; seconded by Angie Modesitt.  The motion passed 5-0.  Meeting adjourned at 6:02 p.m.
