MINUTES OF THE COMMON COUNCIL

BRAZIL, INDIANA

FOR OCTOBER 10, 2018

A meeting of the Common Council was held on October 10, 2018 at 5:04 p.m. in the Council Chambers of the Brazil City Hall. The meeting was called to order by Mayor Brian Wyndham.

ROLL CALL: Steve Bell, Roy Kellar, Shane Litz, Angela Modesitt, Brad Deal and Mayor Brian Wyndham.

The Pledge to the Flag was led by Mayor Brian Wyndham.

OTHERS PRESENT: Clerk-Treasurer Karen McQueen, Frank Phillips of the Brazil Times, City Attorney Traci Orman, Detective Graig Bass, Attorney Jim Deal, Mike Wallace, and Carl Jones.

PRAYER was said by Roy Kellar.

APPROVAL OF MINUTES: Roy Kellar made a motion to approve the September 12, 2018, minutes, seconded by Angie Modesitt.  Passed 4-0.  Brad Deal abstained.

AUDIENCE COMMENTS: NONE

 OLD BUSINESS:

  • Scrivener’s error in Ordinance 18-2017 – This is a date change with the current ordinance. Angie Modesitt made a motion to approve Ordinance 18-2018, seconded by Shane Litz. Passed 5-0.
  • Re-sign Ordinance 3-2018 – All council members except Angie Modesitt, were required to re-sign Ordinance 3-2018.
  • Re-sign Ordinance 4-2018 – All council members were required to re-sign Ordinance 4-2018.
  • Scrivener’s error in Ordinance 17-2018 – Angie Modesitt made a motion to approve Ordinance 17-2018, seconded by Shane Litz. Passed 5-0.
  • Ordinance #5-2018: Second Reading – Salary of Mayor, – Steve Bell made a motion to approve the second reading of Ordinance #5-2018, seconded by Shane Litz. Passed 5-0.
  • Ordinance #6-2018: Second Reading – Salary of the Clerk-Treasurer, Steve Bell made a motion to approve the second reading of Ordinance #6-2018, seconded by Shane Litz. Passed 5-0.
  • Ordinance #7-2018: Second Reading – Salary of the Common Council, Steve Bell made a motion to approve the first reading of Ordinance #7-2018, seconded by Steve Bell. Passed 5-0.
  • Ordinance #8-2018: Second Reading – Salary for Firefighters, Council made a motion to table Ordinance #8-2018 until next meeting.
  • Ordinance #9-2018: Second Reading Salary for Police Officers – Roy Kellar made a motion to approve the second reading of Ordinance #9-2018, seconded by Shane Litz. Passed 5-0.
  • Ordinance #10-2018: Second Reading Salary for Appointed Officers and Employees – Steve Bell made a motion to approve the second reading of Ordinance #10-2018, seconded by Shane Litz. Passed 5-0.
  • Ordinance #11-2018: Second Reading 2019 Budget – Angie Modesitt made a motion to approve the second reading of the 2019 Budget Ordinance #11-2018, seconded by Shane Litz. Passed 5-0.
  • Police Car – decals/wrap proposal. Steve Bell presented council with 3 designs from Clover Signs located in Brazil. Council voted on design #2.  Angie Modesitt proposed that council appropriate no more than $8,000 for police car decals.

 

NEW BUSINESS:

 

  • Erin Withers with Project Life Savers – Erin was present to explain to council the need for these devices in the Clay County area. Erin explained that Terre Haute is already using these devices with Project Life Saver as well.  Councilmen Steve Bell and Shane Litz agreed to form a committee to work on bringing these devices to Clay County.  Councilman Steve Bell also stated that he would reach out to the county 911 and set up a meeting with them to discuss Project Life Saver.
  • Ordinance 12-2018: Petition for Vacation of Alley from Security Investment Properties, LLC, near Chicago Avenue. – Attorney Jim Deal was present to discuss the need to close this alley. Brad Deal made a motion to suspend the rules and pass Ordinance 12-2018 on the first reading, seconded by Shane Litz.  Passed 5-0.  Brad Deal made a motion to approve Ordinance 12-2018, seconded by Shane Litz.  Passed 4-0.  Angie Modesitt
  • Ordinance 13-2018: Petition for Partial Vacation of Alley from Michael D. and Brittany Wallace, near Ashley Street – Attorney Jim Deal was present to discuss the need to close alley. Shane Litz made a motion to suspend the rules and pass Ordinance 13-2018 on the first reading, seconded by Brad Deal.  Passed 5-0.  Shane Litz then made a motion to approve Ordinance 13-2018, seconded by Brad Deal.  Passed 4-0.  Angie Modesitt abstained.
  • Ordinance 14-2018, Golf Carts – City Attorney Traci Orman presented council with Ordinance 14-2018 to allow golf carts and other off road vehicles on the roads. Council decided to table Ordinance 14-2018 until the next meeting in November.
  • Halloween Trick or Treat Hours Shane Litz made a motion for Halloween trick or Treat Hours to be October 30th and 31st from 6-9 p.m., seconded by Brad Deal.  Passed 5-0.

COUNCIL COMMENTS: 

Angie Modesit:  Angie asked Mayor Brian Wyndham if the Clay County Humane Society decided to accept the $25,000 contract between the City of Brazil and the Clay County Humane Society.  Mayor Brian Wyndham stated that Michelle Cannava was talking with her board and would let us know soon the results of that.

MAYOR COMMENTS: NONE

ADJOURNMENT: Brad Deal made a motion to adjourn meeting; seconded by Roy Kellar.  The motion passed 5-0.  Meeting adjourned at 6:35 p.m.
