MINUTES OF THE COMMON COUNCIL

BRAZIL, INDIANA

August 9, 2023

A meeting of the Common Council was held on August 9, 2023, at 5:00 P.m. in Brazil City Hall.  The meeting was called to order by Mayor Brian Wyndham.

PRAYER:  Prayer was led by Steve Bell.

ROLL CALL: Mayor Brian Wyndham and Council Members, Karen Boes, Steve Bell, Angie Modesitt, and Brad Deal.  Shane Litz was absent.

OTHERS PRESENT:

  • City Attorney Traci Orman, Clerk- Treasurer Karen McQueen, Frank Phillips with DLC Media, a representative from the Brazil Times Hayley Cooper, Ryan Cannon with the Brazil City Police Department, Steve Ron Metal and Additives Representative and Brad Emmert with Timberland.     

APPROVAL OF MINUTES:   Karen Boes made a motion to approve the July 12, 2023 Minutes, seconded by Steve Bell.  Motion Passed 4-0.  

AUDIENCE COMMENTS: None

OLD BUSINESS: None

NEW BUSINESS:

  1. Resolution 5-2023:  Emmert Group Properties, LLC request for a 10-year Real Property Tax Abatement – The Redevelopment Commission gave a favorable recommendation for the tax abatement.  Brad Deal made a motion to approve Resolution 5-2023 for a 10-year Real Property Tax Abatement, seconded by Steve Bell.  Motion Passed 4-0.  
  2. Resolution 6-2023: Timberland Home Center request for a 5-year Personal Property Tax Abatement  – The Redevelopment Commission gave a favorable recommendation for the tax abatement.  Steve Bell made a motion to approve Resolution 6-2023 for a 5-year Personal Property Tax Abatement, seconded by Angie Modesitt.  Motion Passed 4-0. 
  3. Resolution 7-2023: Authorizing Application Submission and Local Match Commitment – This is a planning study grant, Planning and Zoning Department plans to pay the $3,600.00 match money.  Karen Boes made a motion to approve Resolution 7-2023, seconded by Brad Deal.  Motion Passed 4-0. 
  4. Ordinance 8-2023: rezoning 10665 N Sr 59 (S1 to I1) – They are planning on moving their corporate office to this location.  The Planning Commission gave a favorable recommendation.  Brad Deal made a motion to approve Ordinance 8-2023, seconded by Angie Modesitt.  Motion Passed 4-0.
  5. Ordinance 9-2023: Rezoning 238 & 240 N Depot (I1 to R3) – The Planning Commission gave a favorable recommendation for rezoning.  Angie Modesitt made a motion to approve Ordinance 9-2023, seconded by Brad Deal.  Motion Passed 4-0.
  6. Ordinance 10-2023: Rezoning 1846 & 1876 W Whiterock (S1 to I1) – Steve Bell made motion to suspend the rules and approve Ordinance 10-2023, seconded by Brad Deal.  Motion Passed 4-0.  Steve Bell then made a motion to approve Ordinance 10-2023, seconded by Brad Deal.  Motion Passed 4-0.     

COUNCIL COMMENTS:

Karen Boes – Stated that she would like the Police Department to enforce the permitting o Golf Carts and ATV’s, especially in Edgewood.  Karen also stated that people are driving lawn mowers in the road with no lights.   

Brad Deal – Stated that he would like the city to look into businesses with Whiterock Parking Lots.  Brad also stated that he would like the city to look into the public nuisances    fines that the city currently has.

MAYOR COMMENTS:

Mayor Brian Wyndham – Mayor Brian Wyndham stated that he is very happy about the potential for the City Planning Grant.  Mayor Brian Wyndham also explained to the council that the Forest Park Basketball Courts needed to be painted before the goals could be installed.  Finally, Mayor Brian Wyndham explained that the Storm Water Project on the Northeast side of town was getting ready to start and that they were currently staging materials on property that Mike Clark owned on US Hwy 40.   

FUTURE AGENDA ITEMS: nextCouncil Meeting September 13, 2023 @ 5 pm. and 1st 2024 Budget Work Session August 16, 2023 @ 9:00 a.m. 

ADJOURNMENT: Brad Deal made a motion to adjourn meeting, seconded by Karen Boes.  Motionpassed 5-0. Meeting adjourned @ 5:53 p.m.
