MINUTES OF THE COMMON COUNCIL

BRAZIL, INDIANA

FOR MARCH 8, 2023

A meeting of the Common Council was held on MARCH 8, 2023, at 5:00 p.m. in Brazil City Hall.  The meeting was called to order by Mayor Brian Wyndham.       

ROLL CALL: Mayor Brian Wyndham and Council Members Shane Litz, Karen Boes, Steve Bell and Angie Modesitt. Brad Deal was absent.   

The Pledge to the American Flag was led by Mayor Brian Wyndham.

OTHERS PRESENT:

  • Clerk-Treasurer Karen McQueen, City Attorney Traci Orman, and Frank Phillips with DLC Media.

PRAYER: The Prayer was led by Karen Boes

APPROVAL OF MINUTES:   Steve Bell made a motion to approve February 8, 2023, Council Minutes, seconded by Shane Litz.  Motion Passed 4-0. 

AUDIENCE COMMENTS: Frank Phillips commented that he appreciates all that the elected officials do. 

OLD BUSINESS:

  1. Noise Ordinance Section 94.05 Brazil City Code of Ordinances – City Attorney Traci Orman sent out Ordinance examples to all council members.  City Attorney Traci Orman stated that the current penalty is set at $25.00 and wanted to know if council wanted to update/increase this penalty?  Angie Modesitt suggested that we change the penalty amount to $150.00 for the first violation with the second violation being $300.00.  All council members were in favor of this suggestion from Angie Modesitt.   

NEW BUSINESS:

  1. Redevelopment Authority 2022 Report – City Attorney Traci Orman present the RDA Annual Financial Report to Council for their review. 
  2. Street Vendor: Proposed Ordinance Provisions – City Planning and Zoning Administer Janet McClellan has proposed the provision.  Council members unanimously decided to table proposed provisions until they can speak with City Planning and Zoning Administrator Janet McClellan.   

COUNCIL COMMENTS:  

  • Steve Bell Mentioned City of Brazil employee Jerry Robison and his 50 years of service with the City of Brazil.  Steve wanted to thank him in the minutes for his service.            
  • Shane Litz – Commented on a job well done with the recent water leak fix in the area of US Hwy 59 and Short Street.  Shane also informed the council that the Forest Park Golf Course was up and running.        
  • Karen Boes – inquired who she needed to talk with regarding the playground equipment at Hendrix Park?  Mayor Brian Wyndham explained that the Park Board would be who she needed to speak with.   
  • Angie Modesitt – inquired when Joink will be done tearing up the roads.  Mayor Brian Wyndham stated that he will address any issues that arise with Joink and believes that they plan to come back and fix all the roads. Mayor Wyndham also stated that construction is a positive thing, and the result will be good.              

MAYOR COMMENTS:

Mayor Brian Wyndham – stated that the City of Brazil is looking at getting a grant to replace water lines, he commented that there are funding sources out there.  

Mayor Brian Wyndham also updated the council on the movement of the Water Main on US Hwy 40.  He explained that things are progressing well.     

Mayor Brian Wyndham commented that it was great to see all the employees who turned out for Jerry Robison’s 50th year recognition lunch.

Mayor Brian Wyndham finally stated that he was looking forward to the year ahead as well as the Community Crossings Project finishing up paving all the roads.  Mayor Brian Wyndham stated that we were close to just doing maintenance on the roads and replacement of sidewalks.              

FUTURE AGENDA ITEMS: nextCouncil Meeting April 12, 2023 @ 5 pm.

ADJOURNMENT: Angie Modesitt made a motion to adjourn meeting, seconded by Karen Boes.  Motion passed 4-0. Meeting adjourned @ 5:37 p.m.
