THE BOARD OF PUBLIC WORKS AND SAFETY

BRAZIL, INDIANA

FOR MAY 13, 2020

A meeting with the Board of Public Works was held on May 15, 2020 at 10:00 a.m. in the Council Chambers of the Brazil City Hall.  The meeting was called to order by Mayor Brian Wyndham.

Pledge was led by Mayor Wyndham

ROLL CALL: Ruthann Jeffries, Linda Messmer, Mayor Wyndham, City Attorney Traci Orman, and Deputy Clerk Melissa Dorsett

OTHERS PRESENT: Fire Chief Jake Bennett, Planning and Zoning Administrator Janet McClellan, Brazil Times Editor Frank Phillips

APPROVAL OF MINUTES: Linda Messmer made a motion to approve the March 11, 2020 and March 20, 2020 minutes, seconded by Ruthann Jeffries.  The motion passed 3-0.

OLD BUSINESS: None

NEW BUSINESS: 

  1. Senior Citizens Memorandum of Understanding – Bob DeCamp attended the March 11, 2020 Council meeting and requested transportation assistance for the Senior Citizens of Clay County. Council approved $6000 to supplement the 2020 budget.  Ruthann Jeffries made a motion to approve the Memorandum of Understanding between the City of Brazil and the Senior Citizens of Clay County; seconded by Linda Messmer.  The motion passed 3-0.
  2. Indot Contract and Award Letter – The City was awarded 3 awards from INDOT (Community Crossings Grant) for a total of $620,568.13 for road paving.  Bids are out and will be opened on the May 20 meeting.  Linda Messmer made a motion to approve the Local Roads and Bridges Matching Grant agreement between INDOT and Brazil, seconded by Ruthann Jeffries.  The motion passed 3-0.
  3. Façade: Approval of Deeds back to Property Owners – The City is moving forward with the Façade Grant and three (3) of the businesses are participating.  Four have opted out.  Since the grant required the property owners to provide the City with Façade Easements, the City will quit claim deed whatever interest was transferred to it, originally, for the grant.  Ruthann Jeffries made a motion to approve the release of the façade easements through Quit Claim Deeds, back to (1) Robert L. Bryant and Mary M. Bryant (110 W. National Ave., McCurdy’s), (2) Eddie H. Dickison and Carlene Dickison (214 E. National Ave., Bedwell Tire), (3) JAGAMA Corporation (24 S. Walnut St., Walnut Theater), and (4) Fraternal Order of Eagles Aux 274, Incorporated (122 E. National Ave.),  seconded by Linda Messmer.  The motion passed 3-0.
  4. Utilities: Agreement for Collection of Accounts – The Utilities’ Office has agreed to use Atlas Collections, Inc., a collection agency as an independent contractor to undertake collection of delinquent accounts.  Ruthann Jeffries made a motion to approve the Agreement for Collection of Accounts between the City of Brazil and Atlas Collections,Inc., seconded by Linda Messmer.  The motion passed 3-0.
  5. Resolution: Bad Check Policy (Utilities) – The City Utilities’ Office at times has had an issue with receiving bad checks and returned ACH payments for utility bills and would like to establish a policy for dealing with said issues.  Linda Messmer made a motion to approve Resolution 5-2020, Establishing a Policy for Utility Payments, seconded by Ruthann Jeffries.  The motion passed 3-0.
  6. Opioid Litigation: Update – Linda Messmer made a motion to disengage with Attorney John Nichols and remain a part of the class action lawsuit, seconded by Ruthann Jeffries.  The motion passed 3-0.
  7. Resolution: Declaring Surplus Property (Real) – The City has real property which it is no longer in need of and wishes to dispose of said real property.  Ruthann Jeffries made a motion to approve Resolution 6-2020, Declaring Real Property as Surplus, seconded by Linda Messmer.  The motion passed 3-0.
  8. Approval of Mowings and Cleanups – Linda Messmer made the motion to approve the Mowing List for May 13, 2020, seconded by Ruthann Jeffries. The motion passed 3-0.  Ruthann Jeffries made a motion to approve the Clean Up List for May 13, 2020, seconded by Linda Messmer.  The motion passed 3-0.
  9. Right of Way Permits – Ruthann Jeffries made a motion to approve Right of Way Permits for Joink to do street cuts, seconded by Linda Messmer. The motion passed 3-0.

CLAIMS:

  1. Clerk’s Office: Linda Messmer made a motion to approve the Clerk’s Office Claims from March 25, 2020 through May 13, 2020; seconded by Ruthann Jeffries.  The motion passed 3-0.
  2. Utilities’ Office: Ruthann Jeffries made a motion to approve the Utilities’ Office Claims from March 25, 2020 through May 13, 2020; seconded by Linda Messmer.  The motion passed 3-0.

ADJOURNMENT: A motion to adjourn the meeting was made by Linda Messmer; seconded by Ruthann Jeffries.  The motion passed 3-0.  Meeting was adjourned at 10:36 a.m.
