MINUTES OF THE BOARD OF PUBLIC WORKS AND SAFETY

BRAZIL, INDIANA

FOR FEBRUARY 13, 2019

A meeting with the Board of Public Works was held on February 13, 2019 at 10:00 a.m. in the Council Chambers of the Brazil City Hall.  The meeting was called to order by Mayor Wyndham.

ROLL CALL: Mayor Wyndham, Ruthann Jeffries, Linda Messmer, City Attorney Traci Orman, Deputy Clerk Melissa Dorsett.

OTHERS PRESENT: Fire Chief Jake Bennett, Police Chief Clint McQueen, Planning and Zoning Administrator Janet McClellan, Planning and Zoning Assistant Cathy Hunter, Brazil Times Editor Frank Phillips, Daniel Rose   

PLEDGE: The pledge to the Flag was led by Mayor Wyndham.

APPROVAL OF MINUTES: Linda Messmer made a motion to approve minutes from January 23, 2019; seconded by Mayor Wyndham.  The motion passed 2-0. (Ruthann Jeffries abstained as she was not present at the January 23, 2019 meeting).

OLD BUSINESS: NONE

POLICE CHIEF REPORT: Chief Clint McQueen

  • Chief McQueen has requested that the Board approve Chandler Damon as a full time Police Officer, to replace retired Police Officer David Archer.  Ruthann Jeffries made a motion to approve Chandler Damon as a full time Police Officer for the City of Brazil; seconded by Linda Messmer.  The motion passed 3-0.   Chief McQueen said that Officer Damon and Officer Cannon will attend the Police Academy in May.

FIRE CHIEF REPORT: Chief Jake Bennett

  • In January the Fire Department had 32 calls for service
  • The Fire Department responded to fires at 509 S. Forest, 608 W. Compton and 303 N. Ashley.  No injuries were reported.
  • Firefighters had EMS training for Cold Weather Emergencies, Rapid Intervention Team Packs and Salvage Tarps.
  • Firefighters installed 11 smoke alarms in jurisdiction in January.
  • Engine 221 had its heater core replaced.

NEW BUSINESS:

  1. Bemis Lawn Maintenance Contract for 2019 – Ruthann Jeffries made a motion to approve the agreement for Lawn Maintenance services between the City of Brazil and Bemis Lawn Care for the year 2019; seconded by Linda Messmer. The motion passed 3-0. 
  2. Resolution 1-2019: Accepting Tax Sale Certificates – The City of Brazil has expressed a desire to obtain certain tax sale certificates for 21 properties from the Clay County Board of Commissioners.  Linda Messmer made a motion to approve Resolution 1-2019: A Resolution to Accept Tax Sale Certificates from Clay County, Indiana By and Through Its Board of Commissioners; seconded by Ruthann Jeffries.  The motion passed 3-0.
  3. Agreement for Services for Opioid Litigation –The City had previously signed an agreement with John Nichols, Cohen & Malad, and Bose McKinney & Evans, but we are no longer working with Cohen & Malad and Bose McKinney & Evans.  A new agreement has been submitted to the Board for approval.  Linda Messmer made a motion to approve the Agreement for Professional Services between the City of Brazil and John P. Nichols, Attorney at Law and Craig Smith, Attorney at Law and to approve Mayor Wyndham as signatory for any changes to the Waiver of Conflict of Interest (changing the number of attorneys from 3 to 2); seconded by Ruthann Jeffries.  The motion passed 3-0.
  4. Clean Up List – Ruthann Jeffries made a motion to approve the Clean Up list for February 13, 2019; seconded by Linda Messmer.  The motion passed 3-0.

  1. Clerk – Linda Messmer made a motion to approve; seconded by Ruthann Jeffries.  The motion passed 3-0
  2. Utilities – Ruthann Jeffries made a motion to approve; seconded by Linda Messmer.  The motion passed 3-0.

ADJOURNMENT: A motion to adjourn the meeting was made by Ruthann Jeffries; seconded by Linda Messmer.  The motion passed 3-0.  Meeting was adjourned at 10:30 a.m.
