THE BOARD OF PUBLIC WORKS AND SAFETY

BRAZIL, INDIANA

FOR DECEMBER 14, 2022

A meeting with the Board of Public Works was held on December 14, 2022, at 10:00 a.m. in the Council Chambers of the Brazil City Hall.  The meeting was called to order by Mayor Wyndham.

Pledge was led by Mayor Wyndham.

ROLL CALL: Mayor Wyndham, Ruthann Jeffries, Linda Messmer, Deputy Clerk Melissa Dorsett, City Attorney Traci Orman

OTHERS PRESENT: Police Chief Clint McQueen, Fire Chief Jake Bennett, Planning and Zoning Administrator Janet McClellan, Assistant Administrator Cathy Hunter, Nick Wilson of the Brazil Times, Brazil Twp. Trustee T.J. Sneddon, John Burke, Daniel Rose

APPROVAL OF MINUTES:  Linda Messmer made a motion to approve the minutes from November 9 and November 23, 2022, seconded by Ruthann Jeffries.  The motion passed 3-0.

AUDIENCE COMMENTS: NONE

POLICE CHIEF REPORT:

  • Chief Clint McQueen reported that Shop with A Cop had another successful year. Around 40 families and 80 kids were able to shop.

    OLD BUSINESS:

  1. Industrial Park Water Project:
  2. Change Order No. 1
  3. Certificate of Substantial Completion and Punch List
  4. B & T Drainage Pay Application No. 9

The Industrial Park Water Project is complete.  There is a Change Order in the amount of $8,659.00 that will be paid out of Water funds.  Linda Messmer made a motion to approve the Change Order No. 1, Certificate of Substantial Completion and Punch List and Pay Application No. 9, seconded by Ruthann Jeffries.  The motion passed 3-0.

 NEW BUSINESS:

  1. TJ Sneddon, Brazil Twp. Trustee – Fire Contract – Brazil Twp. Trustee T.J. Sneddon was present to present the contract between the City of Brazil and Brazil Township for fire protection services.  The amount of the contract has increased from $24,000 annually to $25,000 for the 2023 year.  Ruthann Jeffries made a motion to approve the Fire Protection Contract between the City of Brazil and Brazil Township, seconded by Linda Messmer.  The motion passed 3-0.
  2. JD Burke-Wastewater Adjustment – John Burke was present to discuss his yearly wastewater adjustment for the car wash.  Ruthann Jeffries made a motion to adjust the wastewater down to 2500 cubic feet of usage for January, February, March bills due to be paid in February, March, April 2023, seconded by Linda Messmer. The motion passed 3-0.
  3. Jake Bennett -Phone stipend – Chief Bennett has requested that the firemen be added to the monthly phone stipend.  Linda Messmer made a motion to approve that the firemen be added to the monthly phone stipend.  Linda Messmer rescinded her motion after discussion with the Mayor and City Attorney about taking this request to the Union before coming to the Board of Works.  The request has been tabled.
  4. Cleanup – 104 E. Chestnut – Ruthann Jeffries made a motion to approve a property cleanup at 104 E. Chestnut, seconded by Linda Messmer.  The motion passed 3-0.
  5. 2023 Agreement for Services with Center Point Wastewater Management and Approval of Waiver of Conflict of Interest – The City of Brazil has a contract with the Town of Center Point to continue running operations for its Wastewater Plant, including the use of a certified operator. City Attorney Traci Orman represents both Brazil and Center Point, so there is a need for the Board to sign a conflict of waiver of interest. Linda Messmer made a motion to approve the Agreement for Services between City of Brazil, Indiana and Town of Center Point, Indiana to provide Wastewater services, and the Waiver of Conflict of Interest, seconded by Ruthann Jeffries. The motion passed 3-0.
  6. 2023 Professional Services Contract for Management of Outside Wastewater Contract with Dallas King Jr. – Ruthann Jeffries made a motion to approve the Contract for Management of Outside Wastewater Contracts between the City of Brazil and certified Wastewater Treatment operator, Dallas King, Jr. with compensation of $3,000 (to be paid bi-weekly) for the year 2023, seconded by Linda Messmer.  The motion passed 3-0.
  7. 2023 Engagement Letter with Cox, Zwerner, Gambill & Sullivan – Ruthann Jeffries made a motion to approve the 2023 Engagement Letter with Cox, Zwerner, Gambill & Sullivan to retain an attorney, Traci Orman, with the City of Brazil for $55,848.00 annually, in monthly installments of $4,654.00, in exchange for routine legal services, seconded by Linda Messmer.  The motion passed 3-0.
  8. Graves Construction Invoice – Linda Messmer made a motion to approve invoice #1 from Graves Construction Services for work on the Brazil WWTP Chemical Feed Building in the amount of $101,615.00, seconded by Ruthann Jeffries.  The motion passed 3-0.  This will be paid out of the 2022 Sewage Bond.

   CLAIMS:

  1. Clerk’s Office – Linda Mesmer made a motion to approve the claims from the Clerk’s Office; seconded by Ruthann Jeffries.  The motion passed 3-0.
  2. Utilities’ Office – Ruthann Jeffries a motion to approve the claims from the Utilities’ Office; seconded by Linda Messmer.  The motion passed 3-0.

FUTURE AGENDA ITEMS:

  • The next Board of Works meeting will be on December 28th. 

   ADJOURNMENT: A motion to adjourn the meeting was made by Linda Messmer seconded  

   by Ruthann Jeffries. The motion passed 3-0.  Meeting was adjourned at 10:21 a.m.
