THE BOARD OF PUBLIC WORKS AND SAFETY

BRAZIL, INDIANA

FOR JANUARY 12, 2022

A meeting with the Board of Public Works was held on January 12, 2022, at 10:00 a.m. in the Council Chambers of the Brazil City Hall.  The meeting was called to order by Ruthann Jeffries.

Pledge was led by Ruthann Jeffries.

ROLL CALL: Ruthann Jeffries, Linda Messmer, Deputy Clerk Melissa Dorsett, City Attorney Traci Orman (Mayor Wyndham was absent.)

OTHERS PRESENT: Fire Chief Jake Bennett, Chief Clint McQueen, PZ Administrator Janet McClellan, PZ Asst. Cathy Hunter

APPROVAL OF MINUTES:  Linda Messmer made a motion to approve minutes from December 22, 2021, seconded by Ruthann Jeffries. The motion passed 2-0.

ORGANIZATIONAL MEETING:

  1. Set meeting dates and times for 2022 – Linda Messmer made a motion to keep meetings dates and times the same as previous years.  Board of Works meetings will remain to be on the 2nd and 4th Wednesday of each month at 10:00 a.m. in the Council Chambers at City Hall.

OLD BUSINESS:

  1. Industrial Park Water Project Contracts and Notice to Proceed – Linda Messmer made a motion to approve the Notice to Proceed and Contract with B & T Drainage, seconded by Ruthann Jeffries.  The motion passed 2-0.

NEW BUSINESS:

  1. 728 S. Morgan St., Public Hearing and Unsafe Building Confirmation – A Public Hearing was opened at 10:13 to discuss an unsafe building at 728 S. Morgan St. The property has been assessed and has had a title search which shows no open mortgage and a sewer lien.  The Public Hearing was closed at 10:15. Linda Messmer made a motion to affirm an unsafe building order for 782 S. Morgan St., seconded by Ruthann Jeffries.  The motion passed 2-0.
  2. Right-of-Way Permit for Joink at Pilonis (13 W. National) – Linda Messmer made a motion to approve a Right-of-Way Permit for Joink, seconded by Ruthann Jeffries.  The motion passed 2-0.
  3. Right-of-Way Permit for Joink at 401 S. Murphy – Linda Messmer made a motion to approve a Right-of-Way Permit for Joink, seconded by Ruthann Jeffries.  The motion passed 2-0.
  4. TMO 2022 Engagement Letter – Linda Messmer made a motion to approve the 2022 Engagement Letter from City Attorney Traci Orman, approving a salary of $55,848.00 to be paid to Cox, Zwerner, Gambill & Sullivan, LLP, annually, in monthly installments of $4,654.00, as a retainer for legal services. The motion was seconded by Ruthann Jeffries.  The motion passed 2-0.
  5. IHCDA Water Vendor Program MOA – Linda Messmer made a motion to approve the Low Income Household Water Assistance Program Memorandum of Agreement (MOA) between the IHCDA and the City of Brazil, seconded by Ruthann Jeffries.  The motion passed 2-0.
  6. Resolution 1-2022: 2022 Appointment of Appraisers – Linda Messmer made a motion to approve Resolution 1-2022, A Resolution Appointing Appraisers David Masten and Brian Conley to appraise any potential properties the City may be interested in purchasing in 2022.  The motion was seconded by Ruthann Jeffries.  The motion passed 2-0.

POLICE CHIEF: Chief Clint McQueen

  • Chief McQueen has requested a special Board of Works meeting for January 20, 2022 at 5:00 p.m. for Sergeant promotions for the Police department. 

CLAIMS:

  1. Clerk’s Office – Linda Messmer made a motion to approve the claims from the Clerk’s Office; seconded by Ruthann Jeffries. The motion passed 2-0.
  • Utilities’ Office – Ruthann Jeffries made a motion to approve the claims from the Utilities’ Office; seconded by Linda Messmer. The motion passed 2-0.

FUTURE AGENDA: None

ADJOURNMENT: A motion to adjourn the meeting was made by Linda Messmer seconded by Ruthann Jeffries. The motion passed 2-0. Meeting was adjourned at 10:32 a.m.
