MINUTES OF THE COMMON COUNCIL

BRAZIL, INDIANA

FOR December 21, 2022

A meeting of the Common Council was held on December 21, 2022, at 5:00 p.m. in Brazil City Hall.  The meeting was called to order by Mayor Brian Wyndham.       

ROLL CALL: Mayor Brian Wyndham and Council Members Shane Litz, Karen Boes Steve Bell, and Brad Deal.  Angie Modesitt was absent. 

The Pledge to the American Flag was led by Mayor Brian Wyndham.

OTHERS PRESENT: Clerk-Treasurer Karen McQueen, City Attorney Traci Orman, Brazil City Fire Department Union President Zach Mormans, and Brazil City Fire Department Union Members Chris Moon and Seth Haviland.

PRAYER: The Prayer was led by Steve Bell

APPROVAL OF MINUTES:   Shane Litz made a motion to approve the November 9, 2022, seconded by Karen Boes.  Motion passed 4-0.   Shane Litz then made a motion to approve the November 30, 2022 minutes, seconded by Karen Boes.  Motion passed 3-1.  Brad Deal abstained.

AUDIENCE COMMENTS: None.  

OLD BUSINESS: 

  1. Public Hearing and Second Reading of Ordinance 23-2022: Wastewater charges – Public hearing opened up at 5:06 p.m.  The public hearing was then closed at 5:09 p.m.  Brad Deal made a motion to approve the second reading of Ordinance 23-2022, seconded by Steve Bell.  Motion passed 4-0.
  2. Second Reading of Ordinance 25-2022 of Flood Damage Prevention – Steve Bell made a motion to approve second reading of Ordinance 25-2022, seconded by Shane Litz.  Motion passed 4-0.   
  3. Public Hearing and First Reading of Ordinance 30-2022 – Public Hearing was opened at 5:12 p.m.  The Public Hearing was then closed at 5:14 p.m.  Karen Boes then made a motion to suspend the rules and pass Ordinance 30-2022 on the first reading, seconded by Brad Deal,  Motion passed. 4-0.  Shane Litz then made a motion to approve Ordinance 30-2022, seconded by Brad Deal.  Motion passed 4-0. 
  4. Fund Transfers – Brad Deal made a motion to approve the City Fund Transfers, seconded by Shane Litz.  Motion passed 4-0. 
  5. First Reading, Ordinance 28-2022: No parking on Northside of Church Street between North Walnut and North Washington Street – Steve Bell made a motion to suspend the rules and pass Ordinance 28-2022 on the first reading, seconded by Karen Boes.  Motion passed 4-0. Karen Boes then made a motion to approve Ordinance 28-2022 on the first reading, seconded by Steve Bell.  Motion Passed 4-0.    

NEW BUSINESS:

  1. First Reading, Ordinance 26-2022: Petition for Rezoning (1114 N. Harrison St.) – Karen Boes made a motion to suspend the rules and pass Ordinance 26-2022 on the first reading, seconded by Brad Deal.  Motion passed 4-0.  Brad Deal made a motion to approve Ordinance 26-2022, seconded by Karen Boes.  Motion passed 4-0.   
  2. First Reading, Ordinance 27-2022: Petition for Rezoning (1085 N. Alabama St.) – Brad Deal made a motion to suspend the rules and pass Ordinance 27-2022 on the first reading, seconded by Steve Bell.  Motion passed 4-0.  Steve Bell then made a motion to approve Ordinance 27-2022, seconded by Brad Deal.  Motion passed 4-0.
  3. Resolution 6-2022: Redistricting, City of Brazil continues to be in compliance and districts will stay the same.  Brad Deal made a motion to approve Resolution 6-2022, seconded by Steve Bell.  Motion passed 4-0.    
  4. Fireman’s Union: Memorandum regarding cell phone stipend – Steve Bell made a motion to approve the memorandum for cell phone stipend to the Fireman’s current contract, seconded by Brad Deal.  Motion passed 4-0.  

COUNCIL COMMENTS:  None.

MAYOR COMMENTS: Mayor Brian Wyndham updated the council members on the relocation of the Water line on US Highway 40 and the Phosphorus Building at the wastewater treatment plant, commented that both are coming along.   

FUTURE AGENDA ITEMS: Next council meeting is scheduled for January 11, 2023 @ 5:00 p.m..

ADJOURNMENT: Brad Deal made a motion to adjourn meeting, seconded by Shane Litz.  Motionpassed 4-0. Meeting adjourned @ 5:42 p.m.
