MINUTES OF THE COMMON COUNCIL

BRAZIL, INDIANA

FOR MARCH 13, 2019

 

A meeting of the Common Council was held on March 13, 2019 at 5:00 p.m. in the Council Chambers of the Brazil City Hall. The meeting was called to order by Mayor Brian Wyndham.

ROLL CALL: Steve Bell, Roy Kellar, Angela Modesitt, Brad Deal, Shane Litz and Mayor Brian Wyndham.

The Pledge to the Flag was led by Mayor Brian Wyndham.

Prayer was led by Roy Kellar

OTHERS PRESENT: City Attorney Traci Orman, Deputy Clerk Melissa Dorsett, Jana Wilkes

APPROVAL OF MINUTES:  Roy Kellar made a motion to approve minutes from February 13, 2019, seconded by Shane Litz. The motion passed 5-0.

OLD BUSINESS:

  • Ordinance 5-2019 (revised): An Ordinance Regulating the Operation of Golf Carts and Off-Road Vehicles with the Corporate Limits of the City of Brazil, Indiana – Brad Deal made a motion to suspend the rules and pass on 1st Reading, seconded by Shane Litz. The motion passed 5-0.  Steve Bell made a motion to pass Ordinance 5-2019, seconded by Brad Deal.  The motion passed 5-0.  The Ordinance will be posted on the website.

 

NEW BUSINESS:

  • Ordinance 8-2019: An Ordinance Vacating the Platted Jackson Street (originally named Grant Street) and Alleys West of Union Street in A.S. Hills Addition to Brazil and Adjacent thereto, Petition presented by Attorney Eric Somheil on Behalf of Timberland Home Center, Inc., Timberland Home Center, Sam J. Emmert, and Emmert Group Properties LLC. Shane Litz made a motion to suspend the rules and pass on 1st Reading, seconded by Angie Modesitt.  The motion passed 5-0.  Shane Litz made a motion to pass Ordinance 8-2019, contingent to an easement if utilities are found to be present, seconded by Angie Modesitt.  The motion passed 5-0.
  • Ordinance 6-2019: An Ordinance Amending Ordinance 10-2018 (Adding Animal Control Officer to 2019 Salary Ordinance) – The Animal Control Officer has been added to the budget for 2019, and needs to be added to the Salary Ordinance. Angie Modesitt made a motion to suspend the rules and pass on 1st Reading, seconded by Brad Deal.  The motion passed 5-0.  Angie Modesitt made a motion to approve Ordinance 6-2019, seconded by Brad Deal.  The motion passed 5-0.
  • Ordinance 7-2019: An Ordinance Amending Schedule II of Chapter 75, Title VII regarding Stop Streets (4-way stop at Vandalia and Jackson) – Shane Litz made a motion to suspend the rules and pass on 1st Reading, seconded by Roy Kellar. The motion passed 5-0.  Shane Litz made a motion to pass Ordinance 7-2019, seconded by Roy Kellar.  The motion passed 5-0.

 

COUNCIL COMMENTS: 

  • Steve Bell asked about the possibility of our Street Department painting a crosswalk at Vandalia and Jackson and putting up signs as well.
  • Shane Litz commented that he has always seen a need for a 4-way stop at Vandalia and Jackson.
  • Brad Deal had questions about the logistic of sidewalks on Jackson street concerning the business owners on the South side of the Courthouse. He also asked about the landslide issues on Jackson St.  Mayor Wyndham said that those issues are stabilized.
  • Angie Modesitt asked about the progress of the Community Crossing Paving Project. Traci Orman said that we will have a preconstruction conference in April and will start after that. Wastewater is working on fixing some drainage issues in Edgewood before paving begins in that area. Angie also asked about the Façade Grant.  Traci Orman said that the State Agreement has been signed and submitted and we will progress once it is approved.
  • Roy Kellar noted the drainage repairs made on Alabama Street.

MAYOR COMMENTS:

  • Mayor Brian Wyndham said that the City has a lot of great projects such as the street paving, sidewalk repairs and the façade project and it’s going to be a busy year. Mayor said that we are going to concentrate on finishing these projects before tackling any new ones.  Mayor is also working with members of the community and organizations to refurbish the Korean War jet on the courthouse lawn.

 

ADJOURNMENT: Brad Deal made a motion to adjourn meeting; seconded by Steve Bell.  The motion passed 5-0.  Meeting adjourned at 5:43 p.m.
