MINUTES OF THE COMMON COUNCIL

BRAZIL, INDIANA

FOR SEPTEMBER 14, 2022

A meeting of the Common Council was held on SEPTEMBER 14, 2022 at 5:00 p.m. in Brazil City Hall.  The meeting was called to order by Mayor Brian Wyndham.       

ROLL CALL: Mayor Brian Wyndham and Council Members Shane Litz, Karen Boes, Angie Modesitt, Brad Deal and Steve Bell. 

The Pledge to the American Flag was led by Mayor Brian Wyndham.

OTHERS PRESENT:

  • Attorney James Deal, Frank Phillips representative from WAMB Radio, Rodney Head, Frank Cotton, and Richard Lewis. 

PRAYER: Karen Boes

APPROVAL OF MINUTES: Karen Boes made a motion to approve the August 10, 2022 minutes, seconded by Angie Modesitt.  Motion passed 5-0.

AUDIENCE COMMENTS: NONE

OLD BUSINESS: 

None

NEW BUSINESS:

  1. Ordinance 21-2022 Head Alley Vacation – Shane Litz made a motion to suspend the rules and pass Ordinance 21-2022 on the first reading, seconded by Brad Deal.  Motion passed 5-0.  Shane Litz then made a motion to Approve Ordinance 21-2022, seconded by Brad Deal.  Motion passed 4-1, Angie Modesitt abstained. 
  2. Ordinance 22-2022 Lewis Street & Alley Vacation – Steve Bell made a motion to suspend the rules and pass Ordinance 22-2022 on the first reading, seconded by Shane Litz.  Motion passed 5-0.  Steve Bell then made a motion to Approve Ordinance 22-2022, seconded by Karen Boes.  Motion passed 4-1, Angie Modesitt abstained. 
  3.  Ordinance 20-2022: Right of Way and Street Cut Regulations and Permitting –  Brad Deal made a motion to suspend the rules and pass Ordinance 20-2022 on the first reading, seconded by Angie Modesitt.  Motion passed 5-0.  Shane Litz then made a motion to Approve Ordinance 20-2022 with the provision that on page 6 the violation for the first violation would go from $100.00 to $250.00, seconded by Brad Deal.  Motion passed 5-0. 
  4. Resolution 5-2022: Approving Sale of Old Garage – Board of Public Works and Safety has recommended the sale of property.  The sale would be by Auction on October 5, 2022.  Shane Litz made a motion to Approve Resolution 5-2022, seconded y Angie Modesitt.  Motion passed 5-0.
  5. Ordinance 23-2022: Amending the Permit Fee for Site Development to Connect Mainline Sewer to a Building or Single-Family Dwelling – Steve Bell made a motion to Approve first reading of Ordinance 23-2022, seconded by Brad Deal.  Motion passed 5-0. 
  6. City Attorney Traci Orman discussed the results of the Water Utility Rate Study and the Water Utility Receipts Tax.  Traci explained to council that the rate study had been completed by Baker Tilly and the results of the study concluded that the Water Utility was financially stable.  They also concluded that there would be no need for a decrease of water fees to our customers, due to the elimination of the Utility Receipts Tax.    

COUNCIL COMMENTS:  

  • Steve Bell and Shane Litz – Both stated that there have been many positive comments in the community concerning the paving of the city parking lots.      

MAYOR COMMENTS: Mayor Brian Wyndham stated that the City Hall Parking lot would be paved next and would cost the city roughly $85,000.00 to complete. Mayor Brian Wyndham also informed the council that The City of Brazil was awarded the Storm Water Grant that it had applied for.

ADJOURNMENT: Brad Deal made a motion to adjourn meeting; seconded by Karen Boes. Motionpassed 5-0. Meeting adjourned at 5:54 p.m.
