THE BOARD OF PUBLIC WORKS AND SAFETY

BRAZIL, INDIANA

FOR APRIL 27, 2022

A meeting with the Board of Public Works was held on April 27, 2022, at 10:00 a.m. in the Council Chambers of the Brazil City Hall.  The meeting was called to order by Mayor Wyndham.

Pledge was led by Mayor Wyndham.

ROLL CALL: Mayor Wyndham, Ruthann Jeffries, Linda Messmer, Deputy Clerk Melissa Dorsett, City Attorney Traci Orman

OTHERS PRESENT: Water Superintendent Shawnette Szekely, Planning and Zoning Administrator Janet McClellan, PZ Asst. Cathy Hunter, Fire Chief Jake Bennett, Fire Union President Zach Mormans, Wastewater Superintendent Dallas King, Tony Akles of Strand Associates, Kristy Jerrell of Jerrell Consulting, Council President Steve Bell, Rick Wyndham

APPROVAL OF MINUTES:  Linda Messmer made a motion to approve minutes from April 14, 2022, seconded by Ruthann Jeffries. The motion passed 3-0.

     AUDIENCE COMMENTS: None

     OLD BUSINESS:

  1. Fire Union Contract Agreement – Ruthann Jeffries made a motion to approve the 2022 Salary Schedule Amendment to the salary schedule for the Brazil City Firefighters, effective July 1, 2022; seconded by Linda Messmer.  The motion passed 3-0.

     NEW BUSINESS:

  1. OCRA Stormwater Grant: Public Hearing – A Public Hearing was opened at 10:04 a.m. to discuss the OCRA Stormwater Grant.  (Attached minutes are provided by Grant Administrator Kristy Jerrell.) The Public Hearing was closed at 10:23.
  2. Memorandum of Understanding between City and Senior Citizens – Ruthann Jeffries made a motion to approve the Memorandum of Understanding between the City of Brazil and the Senior Citizens of Clay County, and to provide the Senior Center with $6000 to supplement the 2022 budget for the purpose of assisting with transportation costs, seconded by Linda Messmer.  The motion passed 3-0.  Council has already approved the funding.
  3. Contract – Agreement for Engineering Services (Midwestern Eng.) US 40 Project – The City intends to design, bid and construct improvements to the Water Distribution System for the Industrial Park area and has agreed to hire Midwestern Engineers, Inc for design services, bidding assistance, construction engineering, and inspection services for the project.  Ruthann Jeffries made a motion to approve the Agreement for Engineering Services for Water Improvements Project between the City of Brazil and Midwestern Engineers, Inc., seconded by Linda Messmer.  The motion passed 3-0.
  4. Street Cut Permit – 601 N. Vandalia – Ruthann Jeffries made a motion to approve the emergency street cut permit for John and John Plumbing at 601 N. Vandalia, seconded by Linda Messmer.  The motion passed 3-0.
  5. Right of Way Permit -THSB ATM – Linda Messmer made a motion to approve the Right of Way Permit for Joink, LLC on 110 S. Vandalia for THSB ATM, seconded by Ruthann Jeffries.  The motion passed 3-0.
  6. Engagement Letter: Redistricting 2022 – Linda Messmer made a motion to approve the Engagement Letter from Cox, Zwerner, Gambill & Sullivan, LLP to represent the City in reviewing current council member district boundaries based on 2020 census data information and redistricting same, seconded by Ruthann Jeffries.  The motion passed 3-0.
  7. Engagement Letter: Quite Title (Restlawn) – Ruthann Jeffries made a motion to approve the Engagement Letter from Cox, Zwerner, Gambill & Sullivan, LLP to represent the City in filing a quiet title action in order to obtain an order clarifying ownership of the Restlawn Cemetery, seconded by Linda Messmer.  The motion passed 3-0.
  8. Baker-Tilley URT Agreement for Reduction Study – Linda Messmer made a motion to approve the Scope Appendix to the Engagement Letter between the City of Brazil and Baker Tilly US, LLP for Analysis of Costs and Revenues (Rate Analysis) and Rate Reduction Calculation for Repeal of URT, seconded by Ruthann Jeffries.  The motion passed 3-0.
  9. GAI Contract for Community Crossing Paving Grant – Ruthann Jeffries made a motion to approve the Professional Services Agreement between GAI Consultants, Inc. and the City of Brazil to provide construction observation services for the 2022 Resurfacing Contract and Construction Inspection Project, seconded by Linda Messmer.  The City would like to open bids for the project on June 8, 2022.
  10. Approval of Cleanups – Linda Messmer made a motion to approve the cleanup list for April 27, 2022, seconded by Ruthann Jeffries.  The motion passed 3-0.
  11.  Approval of Mowing – Ruthann Jeffries made a motion to approve the mowing list for April 27, 2022, seconded by Linda Messmer.  The motion passed 3-0.

CLAIMS:

Clerk’s Office – Linda Messmer made a motion to approve the claims from the Clerk’s Office; seconded by Ruthann Jeffries. The motion passed 3-0.

Utilities’ Office – Ruthann Jeffries made a motion to approve the claims from the Utilities’ Office; seconded by Linda Messmer.  The motion passed 3-0.

ADJOURNMENT: A motion to adjourn the meeting was made by Ruthann Jeffries seconded by Linda Messmer. The motion passed 3-0. Meeting was adjourned at 10:51 a.m.
