MINUTES OF THE BOARD OF PUBLIC WORKS AND SAFETY

BRAZIL, INDIANA

FOR JANUARY 10, 2024

A meeting with the Board of Public Works was held on January 10, 2024, at 10:00 a.m. in the Council Chambers of the Brazil City Hall.  The meeting was called to order by Mayor Wyndham.

The Pledge was led by Mayor Wyndham.

ROLL CALL: Mayor Wyndham, Ruthann Jeffries, Linda Messmer, Deputy Clerk Melissa Dorsett, and City Attorney Traci Orman

OTHERS PRESENT: Planning and Zoning Administrator Janet McClellan, PZ Asst. Cathy Hunter, Firefighter Zach Mormans, JD Burk, Daniel Rose, Steve Bender from Midwestern Engineering, Brazil Times Hayley Cooper.

APPROVAL OF MINUTES:  Linda Messmer made a motion to approve the minutes from December 27, 2023, seconded by Ruthann Jeffries.  The motion passed 3-0.

AUDIENCE COMMENTS: None

PUBLIC SAFETY REPORTS: None

ORGANIZATIONAL MEETING:

  • Dates and Times (see list) – Linda Messmer made a motion to approve the 2024 meetings for the Board of Public Works and Safety to remain the 2nd and 4th Wednesdays at 10:00 a.m., seconded by Ruthann Jeffries.  The motion passed 3-0.

     OLD BUSINESS:

  1. Water Main Replacement Project -Steve Bender, Midwestern Engineering – Steve was present to discuss the final pay application from Van Hoy & Son’s for their final work on the Water Main Replacement Project on Highway 40.  Ruthann Jeffries made a motion to approve the Change Order, as presented, seconded by Linda Messmer.  The motion passed 3-0.  The City will pay Van Hoy & Son’s a final payment of $16,844.08.

NEW BUSINESS:

  1. Parks-
  2. Splash Pad – Pay App No. 6 – Ruthann Jeffries made a motion to approve Pay App No. 6 from The Peterson Company for their services on the Splash Pad project from 12/1/23 to 12/31/23 for $27,627.97. seconded by Linda Messmer.  The motion passed 3-0.
  3. Planning and Zoning –
  4. Unsafe Building – 2233 E. Jackson St. – Ruthan Jeffries made a motion to approve the Unsafe Building Affirmation for property at 2233 E. Jackson St., seconded by Linda Messmer.  The motion passed 3-0.
  5. Wastewater-
  6. JD Burk – Linda Messmer made a motion to approve a reduction in wastewater to 2500 cubic feet, therefore reducing the bills for January, February, March (due in February, March and April) for JD Burk, owner of Burks Carwash, seconded by Ruthann Jeffries.  The motion passed 3-0.
  7. 2024 Contract with Centerpoint and Waiver of Conflict of Interest- Ruthann Jeffries made a motion to approve the Agreement for Services between the City of Brazil and Town of Centerpoint to provide any and all necessary services in operating and running the sewage treatment plant for Centerpoint, including providing a certified operator, seconded by Linda Messmer.  The motion passed 3-0.  Traci Ormanis the City Attorney for both the City of Brazil and Town of Centerpoint.  Ruthann Jeffries made a motion to approve the Waiver of Conflict of Interest, seconded by Linda Messmer.  The motion passed 3-0.
  8. Streets-
  9. Contract with GAI Engineering work for Community Crossing 2024-1 – Ruthann Jeffries made a motion to approve the Professional Services Agreement between GAI Consultants and the City of Brazil for engineering services required for the Community Crossings 2024-1 project, seconded by Linda Messmer.  The motion passed 3-0.
  10. Abatement Calculation Agreement -Emmert RP Tax Abatement (RES 2023-8) – Ruthann Jeffries made a motion to approve the Abatement Calculation Agreement between Emmert Group Properties LLC and the City of Brazil, seconded by Linda Messmer.  The motion passed 3-0.
  11. 2024 Engagement Agreement between Cox, Zwerner, Sullivan & Gambill – Linda Messmer made a motion to affirm the 2024 Engagement Agreement between Cox, Zwerner, Sullivan & Gambill, to employ an attorney for the City of Brazil, Traci Orman, seconded by Ruthann Jeffries.  The motion passed 3-0.  The City will pay Cox, Zwerner, Sullivan & Gambill a retainer of $55,848 to be paid in monthly installments of $4,654.00. 

CLAIMS:

  1. Clerk’s Office – Linda Messmer made a motion to approve the claims from the Clerk’s Office, seconded by Ruthann Jeffries.  The motion passed 3-0.
  2. Utilities’ Office – Ruthann Jeffries made a motion to approve the claims from the Utilities’ Office, seconded by Linda Messmer.  The motion passed 3-0.

FUTURE AGENDA ITEMS:

  • The next meeting will be January 24th at 10:00 a.m. in the Council Chambers.

   ADJOURNMENT: A motion to adjourn the meeting was made by Ruthann Jeffries seconded  

   by Linda Messmer.  The motion passed 3-0.  The meeting was adjourned at 10:44 a.m.
