MINUTES OF THE COMMON COUNCIL

BRAZIL, INDIANA

FOR October 29, 2025

A meeting of the Common Council was held on October 29, 2025, at 5:00 p.m. in Brazil City Hall.  The meeting was called to order by Mayor Brian Wyndham.

PRAYER: Was led by Steve Bell

ROLL CALL: Council members present, Steve Bell, Karen Boes, Brad Deal, Shane Litz and Angie Modesitt.  

OTHERS PRESENT:

  • Clerk-Treasurer Karen McQueen, City Attorney Lou Britton, City of Brazil Residents Nick French, Linda Messmer and George Mustgrave.  Also present was Attorney Brenda DeVries with Bose McKinney & Evans LLP.    

APPROVAL OF MINUTES:   Brad Deal made a motion to approve October 8, 2025, seconded by Shane Litz.  Motion Passed 5-0.

AUDIENCE COMMENTS: None

OLD BUSINESS: None

NEW BUSINESS:

  1. Linda Messmer – representing Forest Green – island in roadway – Nick French and Linda Messmer residents of Forest Green subdivision were present to discuss with council the possibility of shrinking or removing an island that is in the roadway and could potentially cause a safety hazard in the future for drivers since new homes have been built.  Nick French gave a presentation with pictures of island in roadway.  Mayor Brian Wyndham stated that he would get a cost estimate on removal of island.  Council members decided to take issue under advisement.     
  2. 2026 Budget – (second reading) – Angie Modesitt made a motion to approve Ordinance 12-2025 the 2026 Budget, seconded by Shane Litz.    Motion approved 5-0.
  3. Ordinance 13-2025 Salaries for Appointed Officials and EmployeesShane Litz made a motion to suspend the rules and pass Ordinance 13-2025 on the first reading with the addition of Troy Farris being added to the spreadsheet, seconded by Brad Deal.  Motion Passed 5-0.  Shane Litz then made a motion to Approve Ordinance 13-2025, seconded by Angie Modesitt.  Motion Passed 5-0.
  4. Ordinance 14-2025 Salary for MayorShane Litz made a motion to suspend the rules and pass Ordinance 14-2025 on the first reading, seconded by Brad Deal.  Motion Passed 5-0.  Shane Litz then made a motion to Approve Ordinance 14-2025, seconded by Angie Modesitt.  Motion Passed 5-0.
  5. Ordinance 15-2025 Salary for Clerk-TreasurerShane Litz made a motion to suspend the rules and pass Ordinance 15-2025 on the first reading, seconded by Brad Deal.  Motion Passed 5-0.  Shane Litz then made a motion to Approve Ordinance 15-2025, seconded by Angie Modesitt.  Motion Passed 5-0.
  6. Ordinance 16-2025 Salary for Common Council – Shane Litz made a motion to suspend the rules and pass Ordinance 16-2025 on the first reading, seconded by Brad Deal.  Motion Passed 5-0.  Shane Litz then made a motion to Approve Ordinance 16-2025, seconded by Angie Modesitt.  Motion Passed 5-0.
  7. Ordinance 17-2025 Salary PoliceShane Litz made a motion to suspend the rules and pass Ordinance 17-2025 on the first reading, seconded by Brad Deal.  Motion Passed 5-0.  Shane Litz then made a motion to Approve Ordinance 17-2025, seconded by Angie Modesitt.  Motion Passed 5-0.
  8. Ordinance18-2025 Salary Firefighters –  Shane Litz made a motion to suspend the rules and pass Ordinance 18-2025 on the first reading with the correction of a date from 2025 to 2026, seconded by Brad Deal.  Motion Passed 5-0.  Shane Litz then made a motion to Approve Ordinance 18-2025, seconded by Angie Modesitt.  Motion Passed 5-0.
  9. Resolution 8-2025 Approval of the form of taxpayer petition, intent to proceed, and establishment of Brazil Municipal Building Corporation – Steve Bell made a motion to Approve Resolution 8-2025, seconded by Brad Deal.  Motion Passed 5-0.
  10. Resolution 9-2025 Approval of transfer of Property to building corporation and appointment of appraisers – Steve Bell made a motion to Approve Resolution 9-2025, seconded by Brad Deal.  Motion Passed 5-0.
  11. Ordinance 19-2025 Approval of form of lease with Building Corporation and pledge of property taxes to the payment of lease rentals – Karen Boes made a motion to Approve Ordinance 19-2025, seconded by Shane Litz. Motion Passed 5-0.

COUNCIL COMMENTS:

  • Angie Modesitt – None
  • Steve Bell – Stated that he would be okay with no parking signs as Forest Green Subdivision around island area and up to Highway 59.
  • Brad Deal – Would like to see fines raised for animal ordinance violations  
  • Karen BoesNone
  • Shane Litz –Stated that Lighting is needed on the road leading into Villas of Hollybrook.  Shane stated that we could use a portion of the bond money to fund this.  

MAYOR COMMENTS:

  • Mayor Brian Wyndham – Stated that there are 5 street lights needed at the Clay Community Schools Subdivision off of Pinckley Street.  Residents have requested street lights.  Potential possibility of using bond money to fund these lights.   

CITY ATTORNEY COMMENTS: None

ADDITIONAL COMMENTS: “As a result of a technological failure and despite its best efforts, the Brazil Common Council was prevented from live streaming, recording, archiving, or maintaining a copy of a live transmission or recording of its meeting held on October 29, 2025, commencing at 5 PM as required by Indiana code §:5-14-1.5-2.9. “

FUTURE AGENDA ITEMS: the nextCouncil Meeting is on November 12, 2025, adoption of the 2026 Budget.

ADJOURNMENT:  Brad Deal made a motion to adjourn the meeting, seconded by Steve Bell.  Motionpassed 5-0. Meeting adjourned @ 6:25 p.m.
