MINUTES OF THE COMMON COUNCIL
BRAZIL, INDIANA
FOR January 14, 2026
A meeting of the Common Council was held on January 14, 2026, at 5:00 p.m. in Brazil City Hall. The meeting was called to order by Mayor Brian Wyndham.
PRAYER: Was led by Angie Modesitt.
ROLL CALL: Council members present, Brad Deal, Shane Litz and Angie Modesitt, Steve Bell was available by phone and Karen Boes was absent.
OTHERS PRESENT:
- Clerk-Treasurer Karen McQueen, City Attorney Lou Britton, and Fire Chief Jake Bennett.
APPROVAL OF MINUTES: Shane Litz made a motion to approve December 23, 2025,
seconded by Angie Modesitt. Motion Passed 4-0.
ELECTION OF OFFICERS: Brad Deal made a motion to nominate Shane Litz as 2026 Council President. All Council members in favor 4-0.

OLD BUSINESS: None
NEW BUSINESS:
- Amendment to the Salary Ordinances 1-2026 Fixing salaries of Appointed and Employees of the city- Shane Litz made a motion to suspend the rules and pass Ordinance 1-2026 on the first reading, seconded by Brad Deal. Motion Passed 4-0. Shane Litz then made a motion to Approve Ordinance 1-2026, seconded by Brad Deal. Motion Passed 4-0.
- Amendment to the Salary Ordinances 2-2026 fixing the salaries for Police Officers – Shane Litz made a motion to suspend the rules and pass Ordinance 2-2026 on the first reading, seconded by Brad Deal. Motion Passed 4-0. Shane Litz then made a motion to Approve Ordinance 2-2026, seconded by Brad Deal. Motion Passed 4-0.
- Amendment to the Salary Ordinances 3-2026 fixing the salaries of Fire Fighters- Shane Litz made a motion to suspend the rules and pass Ordinance 3-2026 on the first reading, seconded by Brad Deal. Motion Passed 4-0. Shane Litz then made a motion to Approve Ordinance 3-2026, seconded by Brad Deal. Motion Passed 4-0.
- Nominations to Brazil Advisory Planning Commission – Brad Deal made a motion to keep appointments the same as the last appointments, seconded by Angie Modesitt. Motion Passed 4-0.
- Nominations to the Board of Zoning Appeals (BZA) – Angie Modesitt made a motion to nominate Brad Deal, seconded by Shane Litz. Motion Passed 4-0. Mayor Brian Wyndham will contact Trey Adams and Rick Packard and see if they would like to stay ion this board and report back to the council.
- Set New Meeting Dates and Times – Council Members made a unanimous decision to keep the meeting dates the second Wednesday of each month and the fourth Wednesday of each month if needed. Meeting times would also stay the same @ 5 pm.
COUNCIL COMMENTS:
- Angie Modesitt – Wanted the council to know that there is a street cut on Hendrix Street and Depot Street that needs addressed.
- Steve Bell – Informed the council that he has had some complaints on the recycling bins at the Republic trash facility. Bins are needing to be dumped more often. Steve also informed council that Lyndsey Lundsford owner of the Edward Jones on Jackson Street wanted to know if there was any progress with her neighbor and clean up of junk cars. Steve will get with Janet McClellan Planning and Zoning Administrator on this issue. Mayor Brian Wyndham stated that currently her neighbor is complaint with current Ordinances.

- Shane Litz –Wanted the council to know that the State will be starting the work on the Overpass on Highway 42 over I-70 soon and this construction will probably affect traffic flow through the City of Brazil.
MAYOR COMMENTS:
- Mayor Brian Wyndham – Stated that he is looking forward to the 2026 year and can’t wait to continue moving forward with upcoming City of Brazil projects. Mayor Brian Wyndham also wanted council to know that the Solar Field at the Wastewater Plant is up and running.
CITY ATTORNEY COMMENTS: None
ADDITIONAL COMMENTS: “As a result of a technological failure and despite its best efforts, the Brazil Common Council was prevented from live streaming, recording, archiving, or maintaining a copy of a live transmission or recording of its meeting held on December 10, 2025, commencing at 5 PM as required by Indiana code §:5-14-1.5-2.9. “

ADJOURNMENT: Brad Deal made a motion to adjourn the meeting, seconded by Angie Modesitt. Motionpassed 4-0. Meeting adjourned @ 5:21 p.m.
