MINUTES OF THE COMMON COUNCIL
BRAZIL, INDIANA
FOR October 8, 2025
A meeting of the Common Council was held on October 8, 2025, at 5:00 p.m. in Brazil City Hall. The meeting was called to order by Mayor Brian Wyndham.
PRAYER: Was led by Karen Boes.
ROLL CALL: Council members present, Steve Bell, Karen Boes, Brad Deal, Shane Litz and Angie Modesitt.
OTHERS PRESENT:
- Clerk-Treasurer Karen McQueen, City Attorney Lou Britton, City of Brazil Code Enforcement Officer Benny Boes, Planning and Zoning Administrator Janet McClellan, Planning and Zoning Administrators Assistant, and Brazil City Fire Chief Jake Bennett.
APPROVAL OF MINUTES: Karen Boes made a motion to approve September 10, 2025, seconded by Angie Modesitt. Motion Passed 5-0.

OLD BUSINESS: None
NEW BUSINESS:
- Petition for Vacation of Alley, Ringo’s First Addition- Attorney Eric Somheil was present to represent property owners surrounding alleyway. Both neighbors approve of alley closure and have requested alley be vacated. Angie Modesitt made a motion to suspend the rules and pass Ordinance #11-2025 pertaining to the Alley Vacation on first reading, seconded by Steve Bell. Motion Passed 5-0. Angie Modesitt then made a motion to approve Ordinance 11-2025 pertaining to Alley Vacation, seconded by Steve Bell. Motion Passed 5-0.
- Public Hearing for 2026 Budget – Mayor Brian Wyndham opened up meeting for the 2026 Budget at 5:08 pm. With no audience comments the Public Hearing was closed at 5:09 pm.
- First Reading of the 2026 Budget – Shane Litz made a motion to approve the first reading of the 2026 Budget, seconded by Brad Deal. Motion Passed 5-0.
- Rabbit Hutch – Diane Miller – Brad Deal made a motion to table, seconded by Shane Litz. Motion tabled 5-0.
- Chicken Coop Catlin O’Dell – Brad Deal made a motion to table, seconded by Shane Litz. Motion tabled 5-0.
- Chicken Coop- Lisa Ward – There are 4 Hens and a Rooster, Code Enforcement Officer Benny Boes stated that chicken coop is in compliance. Shane Litz made a motion to approve chicken coop, seconded by Brad Deal. Motion Passed 5-0.
- Chicken Coop – Clymor – Code Enforcement Officer Benny Boes stated that chicken coop is compliant. Brad Deal made a motion to approve chicken coop, seconded by Karen Boes. Motion Passed 5-0.
- Trick or Treat dates and times – Shane Litz made amotion to have City of Brazil Trick or Treat dates October 30, 2025 and October 31, 2025 from 5:00 pm to 8:00 pm, seconded by Brad Deal. Motion Passed 5-0.
- Eric Day – Ordinance on Firearms – Eric Day explained to council members that on September 11, 2025 that his neighbor shot a cat with a pellet gun killing the cat. Eric Day requested that the Ordinance be updated with stricter and clearer regulations on guns in the City of Brazil. Mayor Brian Wyndham agreed that the Ordinance needs updated.
- Animal Control Ordinance – This was handed out to council to look over and then give suggestions at a later date for additions and corrections to current Ordinance.
- City Pool – This was discussed by Council members. Cost of Pool is a major concern; operation and maintenance expenses continue to go up. The possibility of closing pool and replacing pool with an extended Splashpad was discussed. No audience comments.

- Steve Bell – Asked council what council should do when individuals are on the agenda for chicken coops and then they do not show up? Mayor Brian Wyndham expressed that he would like to see the City of Brazil Code Enforcement Officer approve these requests and not have them on the agenda for approval. Planning and Zoning Administrator Janet McClellan explained that she could get a program on the I-Works System to monitor and give permits to individuals requesting these coops.
- Brad Deal – Would like to see fines raised for animal ordinance violations

MAYOR COMMENTS:
- Mayor Brian Wyndham – Stated that the Colony Acres project is about to start and the project out at the Waste Water Plant for new Solar Field is about complete. Main Water Line is set to start before the end of 2025 as well.
CITY ATTORNEY COMMENTS: None
FUTURE AGENDA ITEMS: the nextCouncil Meeting is on October 29, 2025, adoption of the 2026 Budget.
ADJOURNMENT: Brad Deal made a motion to adjourn the meeting, seconded by Steve Bell. Motionpassed 5-0. Meeting adjourned @ 5:47 p.m.
