MINUTES OF THE COMMON COUNCIL
BRAZIL, INDIANA
FOR MAY 28, 2025
A meeting of the Common Council was held on May 28, 2025, at 5:00 p.m. in Brazil City Hall. The meeting was called to order by Mayor Brian Wyndham.
PRAYER: Was led by Steve Bells.
ROLL CALL: Council members present, Steve Bell, Karen Boes, Brad Deal, Shane Litz and Angie Modesitt.
OTHERS PRESENT:
- Deputy Clerk-Treasurer Jill Bennett, City Attorney Lou Britton, Jared Jernagan from the Banner Graphics, Jessica Lynch and Bill Gabbard with Baker Tilley, Clay County Resident Kade Carter, Tina and Chris Styleburg from Knightsville Town Board, and Clay County Resident Pat Tempist.
APPROVAL OF MINUTES: Brad Deal made a motion to Approveminutes for May 14, 2025, seconded by Karen Boes. Motion Passed 4-1. Angie Modesitt abstained.

NEW BUSINESS:
- Public hearing on water rates and changes – Mayor Brian Wyndham opened up Public hearing at 5:03 pm, Bill Gabbard and Jessica Lynch with Baker Tilley was present to explain to council and residents what rate increase would be used for. They explained that it has been 9 years since the last increase, 2016. Clay County Resident Kade Carter had questions about his personal bill and what the increase would fund. His questions were answered. Tina Styleburg the Water Utility Clerk from Knightsville was present to ask questions on how Knightsville could have a rate study done and then look into increasing there rates as well. Jessica Lynch with Baker Tilley explained that there were lots of municipal financial advisors that could assist them. Clay County Resident Pat Tempist wanted to make sure that there were safeguards in place once the rates were implemented. Mayor Brina Wyndham explained that there were lots of safeguards in place such as annual audits and department budgets. Public Hearing was closed at 5:20 pm.
- Adopt Rate Ordinance 8-2025 – Steve Bell made a motion to approve second reading of Ordinance 8-2025, seconded by Brad Deal. Motion Passed 5-0.
- Adopt Bond Ordinance 7-2025 – Karen Boes made a motion to approve secondreading of Ordinance 7-2025, seconded by Angie Modesitt. Motion Passed 5-0.
- CF – 1 Indiana Powder Coating, Inc. Personal Property – CF-1’s exceeded expectations. Shane Litz made a motion to approve CF-1 as being in substantial compliance, seconded by Angie Modesitt. Motion Passed 5-0.
- CF – 1 Davis Zellar Place, LP – Real Estate Improvement – Council unanimously decided that they would request Davis Zeller Place to resubmit both documents once applications have been completed. Motion Passed 5-0.
- CF – 1 Britt Tool Inc. Personal Property – CF-1’s exceeded expectations. Shane Litz made a motion to approve CF-1 as being in substantial compliance, seconded by Angie Modesitt. Motion Passed 5-0.
- CF – 1 Britt Tool Inc. Real Estate Improvements – CF-1’s exceeded expectations. Shane Litz made a motion to approve CF-1 as being in substantial compliance, seconded by Angie Modesitt. Motion Passed 5-0.
- CF – 1 Owen County Real Estate Holdings, LLC – CF-1’s exceeded expectations. Shane Litz made a motion to approve CF-1 as being in substantial compliance, seconded by Angie Modesitt. Motion Passed 5-0.
COUNCIL COMMENTS:
- Angie Modesitt – Steve Wetnight had some issues with semi’s and cars and requested a “Truck Traffic Only” sign. John Lash has property on Sherman Street and wanted to know if water is turned off at this property should he still be charged for Storm Water? Mayor Brian Wyndham said “Yes” that the charge is for Runoff Water. Marshall Singleton at 304 N. Hoosier St would like the property adjacent to him to be mowed, it is owned by David Miller. Mayor Brian Wyndham stated that he would reach out to David Miller and see what his intentions for the property were going to be. Angie also had a client of hers ask why liens on homes/properties were put-on after-tax sales? The mayor responded that the liens were not intentional and potentially an oversite. If her client would like the liens waived, they should come to a council meeting and ask for the lien to be removed.

- Brad Deal – Does Warren Tire need permission to sell cars? Mayor Brian Wyndham stated that the city did not have any permits for the selling of cars.
