MINUTES OF THE COMMON COUNCIL

BRAZIL, INDIANA

FOR November 12, 2025

A meeting of the Common Council was held on November 12, 2025, at 5:00 p.m. in Brazil City Hall.  The meeting was called to order by Mayor Brian Wyndham.

PRAYER: Was led by Karen Boes

ROLL CALL: Council members present, Steve Bell, Karen Boes, Brad Deal, and Angie Modesitt.  Shane Litz was absent.  

OTHERS PRESENT:

  • Clerk-Treasurer Karen McQueen, City Attorney Lou Britton, City of Brazil Resident’s Bill Stearns and Rachel Wilkeson, owner of Edwards Jones Lynsey Lundsford, Representative with Baker Tilley Kyle Carlson, and Mackenzie Anders.  Also present was Benny Boes code enforcement officer with the City of Brazil.    

APPROVAL OF MINUTES:   Brad Deal made a motion to approve October 8, 2025, seconded by Shane Litz.  Motion Passed 5-0.

AUDIENCE COMMENTS:

  1. Bill Stearns Brazil City Resident who lives off of Hendrix Street would like see his handicap sign be more visible to drivers.  Lowering the sign would be one way to do this.  He also requested the police department to monitor traffic for speeding on this road.  Mayor Brian Wyndham stated that he would talk with the Brazil City Street Commissioner about doing this and get a time frame on completing this.  
  2. Lynsey Lunsford with Edward Jones business located on Jackson Street, requested that the home next to her business clean up its junk cars.  She questioned if there were existing ordnances or something could be created to not allow this within city limits.  It was determined that a Jeff Stewart owns the home and the residence is zoned Business/Transition.  Mayor Brian Wyndham would like to see a fence put up around cars. 

OLD BUSINESS: None

NEW BUSINESS:

  1. Clint McQueen Appropriation Request – Chief of the Brazil City Police Department was present to request from council an appropriation from the Public Safety Fund for some repairs that are needing done in there training building. Clint had estimates for the work, $8,000.00 for the ceiling and $12,000.00 for a new HVAC system.  City of Brazil Attorney Lou Britton explained that Chief McQueen must get 3 quotes for each the repairs before approval can be made.  Chief McQueen explained that he would get the quotes. 
  2. Lease Rental Bond 2025 Public Hearing – Mayor Brian Wyndham opened Public Hearing at 5:23 pm, with no audience comments the Public Hearing was closed at 5:25 pm. 
  3. Second Reading of Ordinance 19-2025 Approval of form of lease with Building Corporation and pledge of property taxes to the payment of lease rentals – Steve Bell made a motion to Approve Ordinance 19-2025, seconded by Brad Deal. Motion Passed 4-0.
  4. First Reading of Ordinance 20-2025 concerning Additional Appropriations for the Lease Rental Bonds of 2025 – Brad Deal made a motion to approve the first reading of Ordinance 20-2025, seconded by Steve Bell.  Motion Passed 4-0.
  5. Resolution 10-2025 forms of Financing Documents – Karen Boes made a motion to approve Resolution 10-2025, seconded by Brad Deal.  Motion Passed 4-0.  
  6. Set Date for second Public Hearing for the Lease Rental Bonds of 2025 – Council decided to set the date of December 10, 2025 @ 5:00 pm.
  7. Ordinance 21-2025 Ratifying and Approving Certain Actions of the Common Council – Brad Deal made a motion to suspend the rules and pass Ordinance 21-2025 on the first reading, seconded by Steve Bell.  Motion Passed 4-0.  Angie Modesitt then made a motion to approve Ordinance 21-2025, seconded by Karen Boes.  Motion Passed 4-0.
  8. Ordinance 22-2025 amending Ordinance 15-2025 fixing the Clerk Treasurer’s Pay for the 2026 Year changing longevity pay to a raise- Brad Deal made a motion to suspend the rules and pass Ordinance 22-2025 on the first reading, seconded by Angie Modesitt.  Motion Passed 4-0.  Brad Deal made a motion to Approve Ordinance 22-2025, seconded by Angie Modesitt.  Motion Passed 4-0. 
  9.  Ordinance 23-2025 amending Ordinance 16-2025 fixing the Common Council’s Pay for the 2026 Year changing longevity pay to a raise- Angie Modesitt made a motion to suspend the rules and pass Ordinance 22-2025 on the first reading, seconded by Steve Bell.  Motion Passed 4-0.  Angie Modesitt made a motion to Approve Ordinance 22-2025, seconded by Steve Bell.  Motion Passed 4-0. 
  10. Ordinance 24-2025 amending Ordinance 14-2025 fixing the Mayor’s Pay for the 2026 Year changing longevity pay to a raise- Karen Boes made a motion to suspend the rules and pass Ordinance 24-2025 on the first reading, seconded by Brad Deal.  Motion Passed 4-0.  Karen Boes made a motion to Approve Ordinance 22-2025, seconded by Brad Deal.  Motion Passed 4-0. 

COUNCIL COMMENTS:

  • Angie Modesitt Stated that the Halloween Downtown was a huge success.
  • Steve Bell – Stated that he would like to ask Christmas in the Park to have parade participants not throw candy this year.  Steve feels that throwing candy could result in someone getting hurt while running into the street to retrieve candy.  
  • Brad Deal – Stated that he would like to see something done about these junk yards in town cleaned up.  
  • Karen Boes – Wanted to let the council know that she had a person approach her at the doctor’s office and stated that they were moving here because they love our community. 
  • Shane Litz –None  

MAYOR COMMENTS:

  • Mayor Brian Wyndham – Stated that the Colony Acres Project is underway and the Solar Fields at the Wastewater Plant are almost complete.
