MINUTES OF THE COMMON COUNCIL
BRAZIL, INDIANA
FOR DECEMBER 27, 2023
A meeting of the Common Council was held on December 27, 2023, at 5:00 p.m. in Brazil City Hall. The meeting was called to order by Mayor Brian Wyndham.
PRAYER: Prayer was led by Karen Boes.
ROLL CALL: Mayor Brian Wyndham and Council Members, Shane Litz, Steve Bell, Karen Boes, Brad Deal and Angie Modesitt.
OTHERS PRESENT:
- Clerk- Treasurer Karen McQueen, City Attorney Traci Orman, a representative from the Brazil Times Hayley Cooper, Brad Emmert with Emmert/Timberland, Kim Emmert O’Dell with Emmert Real Estate, Attorney Mr. Phelps and Brazil City Fire Department Union members Zach Mormans, Raymond Staub and Chris Moon.

AUDIENCE COMMENTS: None
OLD BUSINESS:
- Emmert Residential Tax Abatement: Resolution 8-2023. Kim Emmert gave presentation to the council members and explained the value of giving the futureapartments a tax abatement. Steve Bell made a motion to approve Resoluition 8-2023 with a 10 year tax abatement, motion died with no other seconds. Brad Deal then made a motion to approve Resolution 8-2023 with a 5 year tax abatement, seconded by Angie Modesitt. Motion passed 4-1. Shane Litz Nay.
New Business:
- Alley Vacation: Ordinance 19-2023 – Attorney Mr. Phelps was presented to council all paperwork for vacation of alley for the property owner at 25 South Chicago Avenue. Council member Angie Modesitt would like to see the lot numbers added to the description of the vacation of the alley. City Attorney Traci Orman stated that she would add the necessary wording to the Ordinance. Brad Deal then made a motion to suspend the rules and pass Ordinance 19-2023 on the first reading, seconded by Steve Bell. Motion passed 5-0. Brad Deal then made a motion to approve Ordinance #19-2023, seconded by Karen Boes. Motion passed 5-0.
- Additional Appropriations: Ordinance 20-2023 and Public Hearing – Mayor Brian Wyndham opened up the public hearing for the Additional Appropriations at 5:23 p.m. With no comments from the audience the public hearing was closed at 5:26 p.m. Shane Litz then made a motion to suspend the rules and pass Ordinance 20-2023 on the first reading, seconded by Angie Modesitt. Shane Litz then made a motion to approve Ordinance 20-2023, seconded by Angie Modesitt. Motions passed 5-0.
- City of Brazil Financial Transfers – Steve Bell made a motion to approve transfers for the City of Brazil Financials, seconded by Shane Litz. Motion passed 5-0.

Angie Modesitt – Wanted to thank council for all of there support over the past year.
Steve Bell – Stated that it was nice seeing the board members from Clay City at City Hall on swearing day.

Mayor Brian Wyndham – Stated that he is looking forward to the New Year.
