MINUTES OF THE COMMON COUNCIL

BRAZIL, INDIANA

FOR DECEMBER 6, 2017

 

A meeting of the Common Council was held on DECEMBER 6, 2017 at 5:00 p.m. in the Council Chambers of the Brazil City Hall. The meeting was called to order by Mayor Brian Wyndham.

ROLL CALL: Steve Bell, Brad Deal, Roy Kellar, Shane Litz, and Mayor Brian Wyndham.  Angie Modesitt was absent.

The Pledge to the Flag was led by Mayor Brian Wyndham.

OTHERS PRESENT: City Attorney Traci Orman, Clerk-Treasurer Karen McQueen, Frank Phillips, Linda Jennings, Graig Bass, Ryan Wallace, Jerry and Candy Craddick.

PRAYER was said by Brad Deal.

APPROVAL OF MINUTES:  Brad Deal made a motion to approve the December 6, 2017 minutes, seconded by Shane Litz.  Passed 4-0.

 

AUDIENCE COMMENTS:  Linda Jennings resident at 904 N. Indiana Street would like to request a slow children playing sign at the corner of N. Indiana and Joseph Street.  Brad Deal, Roy Kellar and Shane Litz would like to table decision until they have had a chance to look over situation.

 

OLD BUSINESS:

 

NEW BUSINESS:

  • Police Contract: 2 Year contract, Graig Bass was present to represent the Police Union.  Brad Deal made a motion to approve the Contract, seconded by Steve Bell.  Passed 4-0.
  • Resolution #12-2017 PDF EDA Expansion: The Redevelopment Commission approved EDA expansion.  Resolution #12-2017 is for the final approval from the city for the EDA expansion.  Steve Bell made a motion to approve Resolution #12-2017, seconded by Roy Kellar.  Passed 4-0.
  • Resolution #13-2017 Expansion of the Downtown Economic Development Area: The Redevelopment Commission gave preliminary approval and the Plan Commission approved expansion. Resolution #13-2017 is for the city approval of the Expansion of the Downtown Economic Development Area.  Brad Deal made a motion to approve, seconded by Shane Litz.  Passed 4-0.
  • Request for Handicap Parking Sign – Jerry and Candy Craddick was present to discuss a handicap sign at her residence 824 North Walnut. She explained that vehicles sometimes block her driveway.  Council unanimously agreed that they would like to see yellow lines painted on the curbs for no parking and hopefully issues will be resolved and a handicap parking sign will not be needed.
  • Ordinance #22- 2017 Amending 90.30 – This Ordinance would amend the times of commercial Trash pickup. Brad Deal made a motion to suspend the rules and approve Ordinance #22-2017 on the first reading, seconded by Shane Litz. Passed 4-0.  Brad Deal made a motion to approve Ordinance #22-2017, seconded by Roy Kellar.  Passed 4-0.
  • Resolution 14-2017, Authorizing the purchase of the Duke Energy Building: This Resolution would designate Mayor Brian Wyndham as the signer and Council President Angie Modesitt as the second signer if the Mayor was unable to sign, for the purchase of the Duke Energy Building. Shane Litz made a motion to approve Resolution #14-2017, seconded by Brad Deal.  Passed 4-0.
  • Additional Appropriations, Ordinance #23-2017 Local Road & Bridge Grant, Ordinance #24-2017 Rainy day, Ordinance #25-2017 Loit Special Distribution, Ordinance #26-2017 MVH and Ordinance #27-2017 CCD Fund. Public Hearing for Additional Appropriations was opened up at 5:39 p.m. for Ordinances #23-2017, #24-2017, #25-2017, #26, 2017, #27-2017.  Public Hearing was then closed at 5:40 p.m.  Brad Deal made a motion to suspend the rules and approve Ordinance #23-2017, Ordinance #24-2017, Ordinance #25-2017, Ordinance #26-2017 and Ordinance #27-2017 on the first reading, seconded by Steve Bell.  Passed 4-0.  Brad Deal made a motion to approve Ordinance #23-2017, Ordinance #24-2017, Ordinance #25-2017, Ordinance #26-2017 and Ordinance #27-2017, seconded by Steve Bell.  Passed 4-0.
  • Transfers – Financial Transfers were given to Council members by the Clerk-Treasurer’s Office. Shane Litz made a motion to approve Transfers, seconded by Roy Kellar.  Passed 4-0.
  • Ethics Policy – Council put together a committee to work on the City’s Ethics Policy.  Shane Litz and Brad Deal volunteered to be on the committee.

10.)Animal Control Contract –  Council Approved Mayor Brian Wyndham to negotiate a contract with Langman’s Animal Control.

11.)KIHM Personal Property Tax Abatement- In October a 10year Personal Tax abatement was approved.  KIHM did not sign the Calculation Agreement that was approved in October which makes the Tax Abatement incomplete.  Council approved City Attorney Traci Orman to send letter to the Clay County Auditor and KIHM Metals about abatement being incomplete.

 

 

 

COUNCIL COMMENTS: 

Brad Deal – Stated that he would like to see arrows painted on HWY 40 headed West from Vandalia Street where the road turns from a two lane to a one lane, to inform drivers of the change.

 

MAYOR COMMENTS: Mayor Brian Wyndham would like to congratulate the Christmas in the Park on a great Christmas Parade, stated it is the best around.

Brad Deal made a motion to adjourn meeting; seconded by Steve Bell.  Passed 4-0.  6:45 p.m.
