MINUTES OF THE COMMON COUNCIL

BRAZIL, INDIANA

FOR May 13, 2026

A meeting of the Common Council was held on May 13, 2026, at 5:00 p.m. in Brazil City Hall.  The meeting was called to order by Councilman Steve Bell.  Mayor Brian Wyndham was absent.

PRAYER: Was led by Steve Bell.

ROLL CALL: Council members present, Brad Deal, Angie Modesitt, Steve Bell and Karen Boes.  Shane Liz was absent.

OTHERS PRESENT:

  • Clerk-Treasurer Karen McQueen, City Attorney Lou Britton, Planning and Zoning Administrator Janet McClellan and City of Brazil Resident Marjorie Hopkins.   

APPROVAL OF MINUTES:   Karen Boes made a motion to approve April 8, 2026,

seconded by Brad Deal.  Motion Passed 4-0.

AUDIENCE COMMENTS:

OLD BUSINESS: None

NEW BUSINESS:

  1. Application for a chicken coop – 5 chickens and no roosters – Janet McClellan Planning and Zoning Administrator was present for questions concerning application on chicken coop, she found chicken coop to be in compliance and Code Enforcement Officer Benny Boes inspected coop.  Janet McClellan asked council to approve the chicken coop. Brad Deal made a motion to approve chicken coop for Brandon and MacKenzie Rothrock, seconded by Karen Boes.  Motion Passed 4-0.
  2. Marjorie Hopkins – Speed Limit Signs – Marjorie live in the City of Brazil corporal limits on Central Avenue. Marjorie requested that something be done with the speeding on Central Avenue.  She would like to see peed limit signs, speed bumps or a police presence to slow drivers down.  Marjorie is afraid that someone will be hit by a car due to speeding.  Councilman Steve Bell explained that he would talk with the Chief of Police Clint McQueen about the situation and see what could be done to slow drivers down. 
  3. Abatement for Davis Zellar Place, LP – City Attorney looked over abatement and stated that abatement was compliant and asked council to approve compliance.  Angie Modesitt made a motion of substantial compliance of abatement, seconded by Brad Deal.  Motion Passed 4-0. 
  4. Abatement for Indiana Powder Coating, Inc. – City Attorney looked over abatement and stated that abatement was compliant and asked council to approve compliance.  Angie Modesitt made a motion of substantial compliance of abatement, seconded by Brad Deal.  Motion Passed 4-0. 
  5. Abatement for Owen County Real Estate Holding, LLC – City Attorney looked over abatement and stated that abatement was compliant and asked council to approve compliance.  Angie Modesitt made a motion of substantial compliance of abatement, seconded by Brad Deal.  Motion Passed 4-0. 
  6. Clerk-Treasurer Karen McQueen asked council if they would approve the closing of two (2) checking accounts, Construction Bond 2019 – Account ending in #0408 and Construction Bond 2020 – Account ending #2974.  City Attorney Lou Britton stated that he would create a Resolution for the closing of the accounts.

ADJOURNMENT:  Brad Deal made a motion to adjourn the meeting, seconded by Angie Modesitt.  Motionpassed 4-0. Meeting adjourned @ 5:21 p.m.
