MINUTES OF THE COMMON COUNCIL
BRAZIL, INDIANA
FOR APRIL 13, 2016

A meeting of the Common Council was held on April 13, 2016 at 5:00 p.m. in the Council Chambers of the Brazil City Hall. The meeting was called to order by Mayor Brian Wyndham.

ROLL CALL: Mayor Brian Wyndham, Steve Bell, Brad Deal, Roy Kellar, Shane Litz, Angela Modesitt. Also in attendance: Clerk-Treasurer Karen McQueen, City Attorney Traci Orman
The Pledge to the Flag was lead by Mayor Wyndham
OTHERS PRESENT: Dan Hedden of Umbaugh, Mike Evans, Russell Barnett, Harvey Roscoe, Jerry Lancaster, Steve Withers, Jerry Peebles, Bill Lovett, Troy Farris, Janet Trout, Ruthann Jeffries, Stephanie Campbell of PCS Engineers, Nick Brunett, Linda Minnick, James Deal, Atty., Brock Dalton, Atty., and Tim Skinner

APPROVAL OF MINUTES: March 9, 2016, Roy Kellar made a motion to approve; seconded by Angie Modesitt. The motion passed 5-0. March 16, 2016, Shane Litz made a motion to approve; seconded by Brad Deal. The motion passed 5-0.

AUDIENCE COMMENTS: Jerry Lancaster commented that there weren’t enough parking spaces for meetings at City Hall. Mayor Wyndham will look into this issue.

A Public Hearing was opened at 5:07 p.m. for discussion on the Water Rate Incrase. Dan Hedden of Umbaugh & Associated was present to help with any questions or comments regarding the Water Rate Increase. The Public Hearing was closed at 5:15 p.m.

OLD BUSINESS:
1.) Ordinance 6-2016: An Ordinance Establishing Rates and Charges-Waterworks Utility of the City of Brazil, Indiana (second reading) – Brad Deal made a motion to pass Ordinance 6-2016 with an amendment to change the effective date from the April bill to pay in May, to the June bill to pay in July; seconded by Steve Bell. The motion passed 5-0.
2.) Ordinance 4-2016: An Ordinance Amending Chapter 94, Title IX of the City of Brazil, Indiana Code of Ordinance Concerning Public Nuisances – Brad Deal made a motion to suspend the rules; seconded by Shane Litz. The motion passed 5-0. The motion passed 5-0.

NEW BUSINESS:
1.) Chicken Coop Application-Burnett – Nickolas Burnett has completed the application and has given the Council all necessary papers to proceed with a chicken coop. Shane Litz made a motion to approve the application from Nickolas Burnett and to allow a chicken coop at 21 W. Posey Street; seconded by Roy Kellar. The motion passed 5-0.
2.) Janet Trout- Old Hill Cemetery – Janet Trout presented a letter to the Council concerning broken and damaged grave stones at Old Hill Cemetery. Mayor Wyndham asked Janet to look into grants and/or funding for ideas to fix this issue. Mayor Wyndham will also be getting figures together to fix these headstones. The City currently has $19,799 in Cemetery Non-Reverting Funds. Brad Deal agreed with the Mayor. Steve Bell would like to involve the Historical Society in this project.
3.) Ordinance 7-2016: Petition for Vacation (Mary Ann Hofmann) – Brock Dalton, Atty., has been working on this petition for a Habitat for Humanity home. Mayor Wyndham would like to look at the property, do line locates and will be in touch with Brock Dalton.
4.) Ordinance 8-2016: Petition for Vacation (Robert M. & Vicki L. Shorter) – Jim Deal, Atty., was present as an Attorney for the owners, Robert and Vicki Shorter, and asked for vacation of the property. Brad Deal, Steve Bell and Roy Kellar would like to have a line locate. Brad Deal made a motion to table the vacation of property until the next Council meeting; seconded by Shane Litz. The motion passed 5-0.
5.) Golf Course –Improvements and Equipment – The Golf Board is in need of a loan to do improvements to the Forest Park Golf Course and are present to ask the Council for funding from the City. $216,495 is the needed amount. Brad Deal is in favor of loaning $160,000.00. Clerk-Treasurer Karen McQueen suggested moving $136,606.00 to the Rainy Day Fund, then loaning $160,000.00 to the Golf Course to be reimbursed to the Rainy Day Fund at $20,000.00 per year for 8 years. Brad Deal made a motion to approve moving $136,606.00 to the Rainy Day Fund, and loaning $160,000.00 to the Golf Course, to be reimbursed to the Rainy Day Fund at $20,000.00 per years for 8 years; seconded by Shane Litz. The motion passed 5-0. Payments will be made starting June 30, 2017, and will be made annually on this date.
6.) LED Lighting Project –True Champion Consulting has submitted a proposal to reduce energy costs for the City of Brazil by switching to LED lights. Shane Litz made a motion to approve the recommendations for LED lights for the City; seconded by Brad Deal. The motion passed 5-0.
7.) Report from Planning and Zoning – A report was submitted to the Council from Planning and Zoning Administrator Teresa Glenn, and will be reviewed.

ADJOURNMENT:
Brad Deal made a motion to adjourn meeting, seconded by Shane Litz. Motion passed 5-0. Meeting adjourned at 6:54 p.m.
