MINUTES OF THE COMMON COUNCIL
BRAZIL, INDIANA
FOR DECEMBER 14, 2016

A meeting of the Common Council was held on December 14, 2016 at 5:00 p.m. in the Council Chambers of the Brazil City Hall. The meeting was called to order by Mayor Brian Wyndham.
ROLL CALL: Mayor Brian Wyndham, Steve Bell, Brad Deal, Roy Kellar, Shane Litz, Angela Modesitt.
The Pledge to the Flag was lead by Mayor Wyndham.
OTHERS PRESENT: City Attorney Traci Orman, Clerk-Treasurer Karen McQueen, Brazil Police Officer Graig Bass, Brazil Police Officer Todd Stemm, Steve Braden, Kerrie McMillan
PRAYER was said by Brad Deal.
APPROVAL OF MINUTES: Shane Litz made a motion to approve minutes from November 11, 2016; seconded by Steve Bell. The motion passed 3-0.
AUDIENCE COMMENTS:
1.) Kerrie McMillan of 405 S. King St. owns property included in the FEMA Phase III Buyout. Ms. McMillan is concerned that she will have to be out of her home by December 21st and thought that she would have 60 days. She requests that the date be pushed back to January 13, 2017. The City has decided to honor this request.

OLD BUSINESS:
1.) Ordinance 21-2016: Additional Appropriations- Second Reading– Shane Litz made a motion to approve Ordinance 21-2016: Additional Appropriations; seconded by Angie Modesitt. The motion passed 5-0.

NEW BUSINESS:
1.) Election of Officers for 2017 – Brad Deal made a motion to nominate Angie Modesitt as Council President for 2017; seconded by Steve Bell. The motion passed 5-0. Brad Deal made a motion to nominate Steve Bell as Council Vice President for 2017; seconded by Roy Kellar. The motion passed 5-0.
2.) Set Meeting Dates and Time for 2017 Meetings – Brad Deal made a motion to keep meeting times and dates the same as 2016; seconded by Shane Litz. The motion passed 5-0. 2017 Council meetings will be the second Wednesday of every month at 5:00 p.m.
3.) Reappointment of Advisory Planning Committee Members -(Roy Kellar and Angie Modesitt) – Shane Litz made a motion to reappoint Roy Kellar and Angie Modesitt to the Advisory Planning Committee; seconded by Brad Deal . The motion passed 5-0.
4.) Brazil FOP Contract – This is a one year agreement through 2017 between the City of Brazil and the Fraternal Order of Police Clay County Lodge #114. Mayor Wyndham is in favor of the agreement was well as the Board of Works. The approval of the agreement will be tabled until the December 20th meeting at 5:00 p.m.
5.) Ordinance 10-2016: An Ordinance Amending Ordinance 2-2007 – This is an ordinance relating to charges, policies and procedures of the City of Brazil Public Sewer System. It has come to the attention of the City that a provision needs to be added to the ordinance in order to deal with the issue of waste loads originating outside of Clay County. Roy Kellar made a motion to suspend the rules and pass on 1st Reading; seconded by Brad Deal. The motion passed 5-0. Roy Kellar made a motion to pass Ordinance 10-2016: An Ordinance Amending Ordinance 2-2007 (An Ordinance Amending Chapter 50 (Title V) of the Brazil City Code of Ordinance Relating to Charges, Policies, and Procedures of the City of Brazil Public Sewer System); seconded by Angie Modesitt. The motion passed 5-0.
6.) Resolution 11-2016: A Resolution of the Common Council Setting Forth a Travel Policy for City Employees, Appointees, and Elected Officials – The City does not currently have in place a policy regarding reimbursement of travel expense and would like to put in place its travel policy so as to clarify what expenses are reimbursable and the parameters of each. Steve Bell made a motion to approve Resolution 11-2016; seconded by Brad Deal. The motion passed 5-0.
7.) Resolution 12-2016: Establishing Internal Controls Standards and Materiality Thresholds – The City of Brazil recognizes its responsibility to the residents and taxpayers of Brazil to maintain minimum internal control standards as defined by the State Board of Accounts. Shane Litz made a motion to approve Resolution 12-2016; seconded by Steve Bell. The motion passed 5-0.
8.) Ordinance 22-2016: An Ordinance Amending Chapter 156, Title XV of the Brazil Code of Ordinances and Adopting Amending Zoning Map – The City of Brazil zoning map needs to updated and amended, and the Brazil Advisory Plan Commission had identified several parcels which are in need of rezoning in order for there to be a more cohesive and comprehensive zoning designations of parcels within the City and in the two-mile radius. Shane Litz made a motion to suspend the rules and pass on first reading; seconded by Roy Kellar. The motion passed 5-0. Shane Litz made a motion to approve Ordinance 22-2016; seconded by Steve Bell. The motion passed 5-0.
9.) End of Year Transfers – Shane Litz made a motion to approve the end of year transfers; seconded by Angie Modesitt. The motion passed 5-0.

Brad Deal made a motion to adjourn meeting; seconded by Roy Kellar. Motion passed 5-0. Meeting adjourned at 6:30 p.m.
